HOUSE BILL No. 5328

 

September 9, 2009, Introduced by Reps. Hansen, Meekhof, Marleau, Booher, Horn, Stamas, Proos, Kurtz, Pearce, Tyler, Moss, Denby, Meltzer, Wayne Schmidt, Agema, Kowall, McMillin, Pavlov and Calley and referred to the Committee on Tourism, Outdoor Recreation and Natural Resources.

 

     A bill to amend 1994 PA 451, entitled

 

"Natural resources and environmental protection act,"

 

(MCL 324.101 to 324.90106) by adding part 14.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

PART 14. FINES

 

     Sec. 1401. As used in this part:

 

     (a) "Department" means the department of environmental

 

quality.

 

     (b) "Violation of this act" means a violation of a provision

 

of this act administered by, a rule promulgated by, or a permit

 

issued by the department.

 

     Sec. 1403. Notwithstanding any other provision of this act,

 

staff time of the department shall not be considered in calculating

 

any fine, including a fine under a consent agreement, for a

 

violation of this act if the fine will, in whole or part, be

 

deposited in a fund dedicated by law, in whole or part, to paying

 

salaries or benefits for department staff.
