AN ACT to make, supplement, and adjust appropriations for various state departments and agencies for the fiscal year ending September 30, 2016; and to provide for the expenditure of the appropriations.

The People of the State of Michigan enact:

PART 2

PROVISIONS CONCERNING APPROPRIATIONS

GENERAL SECTIONS

Sec. 201. In accordance with the provisions of section 30 of article IX of the state constitution of 1963, total state spending from state resources in this appropriation act for the fiscal year ending September 30, 2016 is $48,700,000.00 and state appropriations paid to local units of government are $48,700,000.00 as follows:

Sec. 202. The appropriations made and expenditures authorized under this act and the departments, commissions, boards, offices, and programs for which appropriations are made under this act are subject to the management and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.

DEPARTMENT OF TREASURY

Sec. 301. (1) Subject to subsection (2), the funds appropriated in part 1 for distressed public schools financial assistance are to be used for a financial emergency in a school district with the same boundaries as a city with a population of 600,000 or more. The funds shall provide resources for daily operational costs of running the distressed school district. The state, the emergency manager, and the distressed school district shall enter into an agreement to provide for the expenditure of the funds.

(2) The state treasurer shall not release the funds described in subsection (1) unless the distressed school district is subject to a financial review commission under the Michigan financial review commission act, 2014 PA 181, MCL 141.1631 to 141.1643, or section 12(4) of the Michigan financial review commission act, 2014 PA 181, MCL 141.1642, applies to the distressed school district.

This act is ordered to take immediate effect.
