HOUSE BILL No. 5205

 

July 16, 2009, Introduced by Rep. Robert Jones and referred to the Committee on Commerce.

 

     A bill to authorize the state administrative board to convey

 

certain interests in property in Kalamazoo county; to prescribe

 

certain conditions for the conveyance; and to provide for

 

disposition of the revenue derived from the conveyance.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. The state administrative board, on behalf of the

 

state, may convey to western Michigan university, for consideration

 

of $1.00, the right of reverter and the right of reentry contained

 

in the July 22, 1989, quitclaim deed to western Michigan university

 

recorded in Liber 2083 page 1264, Kalamazoo county records, on real

 

property located in Kalamazoo county, Michigan, and more

 

particularly described as:

 

     The north half of lot thirty-six (36) of plat no. two (2) or

 

revised plat of section sixteen (16), town two (2) south, range


 

eleven (11) west, except commencing at the southwest corner of said

 

north half, thence north twenty-six and two-thirds (26 2/3) rods,

 

thence east eighteen (18) rods, thence south twenty-six and two-

 

thirds (26 2/3) rods, and thence west eighteen (18) rods to the

 

place of beginning, and also except commencing two (2) rods south

 

of a point two (2) rods west of the northeast corner of said lot

 

thirty-six (36), thence west seventeen (17) rods, thence south

 

twelve (12) rods, thence west three (3) rods, thence south eight

 

(8) rods, thence east twenty (20) rods, and thence north twenty

 

(20) rods to the place of beginning.

 

     Also, a piece of land on the north side of North Street

 

beginning at a point on the north line of North Street, said point

 

being one hundred thirty-two (132) feet west of the west line of

 

Denner Street and five hundred twenty-eight (528) feet north of the

 

east and west quarter line of section sixteen (16), town two (2)

 

south, range eleven (11) west, running thence north on hundred

 

thirty-two (132) feet, thence west five hundred two and six tenths

 

(502.6) feet, thence south one hundred thirty-two (132) feet to a

 

point on the north line of North Street six hundred thirty-four and

 

seventy-three hundredths (634.73) feet west of the west line of

 

Denner Street, thence east on the north line of North Street five

 

hundred two and seventy-three hundredths (502.73) feet to the place

 

of beginning.

 

     Sec. 2. The description of the parcel in section 1 is

 

approximate and for purposes of the conveyance is subject to

 

adjustment as the state administrative board or attorney general

 

considers necessary by survey or other legal description.


 

     Sec. 3. The conveyance authorized by this act shall be by

 

instrument approved by the attorney general.

 

     Sec. 4. The revenue received under this act shall be deposited

 

in the state treasury and credited to the general fund.

 

     Enacting section 1. This act does not take effect unless all

 

of the following bills of the 95th Legislature are enacted into

 

law:

 

     (a) Senate Bill No.____ or House Bill No. 5207(request no.

 

02739'09).

 

     (b) Senate Bill No.____ or House Bill No. 5206(request no.

 

02740'09).
