HOUSE BILL NO. 5202

A bill to amend 1952 PA 8, entitled

"Revised uniform reciprocal enforcement of support act,"

by amending sections 9a and 19 (MCL 780.159a and 780.169), section 9a as added and section 19 as amended by 1985 PA 172.

the people of the state of michigan enact:

Sec. 9a. All duties of support, including the duty to pay arrearages, are enforceable by a proceeding under this act including a proceeding for civil contempt. The defense that the parties are immune to suit because of their relationship as husband and wife a married couple or parent and child is not available to the obligor.

Sec. 19. Laws attaching a privilege against the disclosure of communications between husband and wife spouses are inapplicable to proceedings under this act. Husband and wife Spouses are competent witnesses and may be compelled to testify to any relevant matter, including marriage and parentage.

Enacting section 1. This amendatory act does not take effect unless Senate Joint Resolution ____ or House Joint Resolution ____ (request no. 02344'21) of the 101st Legislature becomes a part of the state constitution of 1963 as provided in section 1 of article XII of the state constitution of 1963.
