A bill to amend 1977 PA 89, entitled
"State aid to public libraries act,"
by amending section 17 (MCL 397.567), as amended by 2001 PA 65.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
17. (1) A Except
as otherwise provided in this section, a
cooperative library and public library shall conform to
certification requirements for personnel as established by the
department in order to qualify for state aid.
(2) A volunteer public library may receive state aid without
meeting the operational standards otherwise required of a public
library to receive state aid. However, annual state aid to a
volunteer public library shall not exceed an amount equal to the
sum of all of the following in the immediately preceding year:
(a) Appropriations received from the local unit of government.
(b) The monetary donations the public library received through
gifts and fund-raising.
(c) The value of in-kind contributions such as services,
goods, and supplies. For purposes of this subdivision, in-kind
volunteer staffing services shall be valued at the minimum wage
rate established in section 4 of the minimum wage law of 1964, 1964
PA 154, MCL 408.384.
(3) As used in this section, "volunteer public library" means
a public library that meets all of the following criteria:
(a) Is established under section 13a of the charter township
act, 1947 PA 359, MCL 42.13a.
(b) Has unpaid volunteers as a majority of the library staff.
(c) Has a certified librarian on its library advisory board or
on the library staff.
(d) Is open to the public for an average of 20 or more hours
each week.
