HOUSE BILL NO. 5165

A bill to establish a making a difference for a teacher award program; to create the made a difference teacher fund in the department of treasury; to provide for the distribution of the money from the fund; to prescribe the powers and duties of certain agencies and officials; and to provide for appropriations.

the people of the state of michigan enact:

Sec. 1. This act shall be known and may be cited as the "making a difference for a teacher act".

Sec. 3. As used in this act:

(a) "Department" means the department of treasury.

(b) "Fund" means the made a difference teacher fund created in section 7.

(c) "Making a difference for a teacher award program" or "program" means the program created in section 5.

(d) "State-certified teacher" means an individual who holds a valid teaching certificate issued by the superintendent of public instruction under section 1531 of the revised school code, 1976 PA 451, MCL 380.1531.

Sec. 5. (1) The department shall establish a making a difference for a teacher award program to recognize state-certified teachers who go above and beyond to make a difference in the lives of children. The department shall accept nominations from anyone, in a form and manner as prescribed by the department. The department may create an advisory group to review the nominations and select recipients of the award.

(2) The department shall grant awards annually in the amount of $1,000.00 to each state-certified teacher who has been selected from the nominations by the advisory group. The number of awards each year shall be determined by dividing the amount in the making a difference for a teacher fund by $1,000.00.

Sec. 7. (1) The made a difference teacher fund is created as a separate fund in the department to offer awards to state-certified teachers through the making a difference for a teacher award program. The department shall be the administrator of the fund for auditing purposes.

(2) The state treasurer shall credit to the fund all amounts appropriated for this purpose under section 435 of the income tax act of 1967, 1967 PA 281, MCL 206.435, and money from any other source for deposit into the fund.

(3) The state treasurer shall direct the investment of the fund. The fund shall consist of the money credited to the fund pursuant to section 435 of the income tax act of 1967, 1967 PA 281, MCL 206.435, any interest and earnings accruing from the saving and investment of that money, and money from any other source.

(4) Money in the fund at the close of the year shall remain in the fund and shall not lapse to the general fund.

Sec. 9. The money, interest, and earnings of the fund shall be expended solely to offer awards and recognize state-certified teachers who have been nominated for the award under the making a difference for a teacher award program.

Sec. 11. The money in the fund that is available for distribution shall be appropriated each year. Money granted or received as a gift or donation to the fund is available for distribution upon appropriation.

Enacting section 1. This act does not take effect unless Senate Bill No.____ or House Bill No. 5166 (request no. 02899'19 **) of the 100th Legislature is enacted into law.
