VerHeulen, Goike, Outman, Victory, Schor, Dillon, Brinks, Singh, Zemke, Leonard, Cochran, Callton, Kivela, MacGregor, Abed, Rendon, Hooker, Pscholka, Stallworth, Hobbs, Shirkey, Foster, Kesto, Walsh, Durhal, Howrylak, McCready, Crawford, LaFontaine, Haveman and Haines and referred to the Committee on Regulatory Reform.

 

     A bill to amend 2000 PA 274, entitled

 

"Large carnivore act,"

 

by amending section 3 (MCL 287.1103).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 3. (1) A person shall not do any of the following:

 

     (a) Own or possess a large carnivore except in compliance with

 

this act.

 

     (b) Breed Except as provided in subsection (2), breed a large

 

carnivore.

 

     (c) Transfer ownership or possession of or receive a transfer

 

of ownership or possession of a large carnivore, with or without

 

remuneration, . This subdivision does not apply to a unless the

 

transfer of ownership or possession of a large carnivore is

 


expressly authorized or required by this act.

 

     (2) Subsection (1)(b) does not apply to an accredited

 

zoological park, a person holding a class C license under 9 CFR

 

part 2, or a person holding a United States fish and wildlife

 

service captive-bred wildlife registration under 50 CFR part 17

 

that meets both of the following conditions:

 

     (a) Is breeding the large carnivore for conservation purposes

 

as part of an approved science-based breeding program.

 

     (b) Is not breeding the large carnivore for the purpose of

 

selling, bartering, leasing, or trading the animal or its offspring

 

or animal parts for commercial profit.

 

     (3) As used in this section, "science-based breeding program"

 

means a cooperative, organized breeding program approved by this

 

state that includes all of the following:

 

     (a) A demonstration of financial sustainability.

 

     (b) Physical facilities to house animals, including progeny.

 

     (c) A long-term genetic management plan.

 

     (d) A system of record-keeping.

 

     (e) A relationship between the program and conservation of the

 

species in the wild.

 

     (f) Plans for placement of all animals as part of ongoing

 

program implementation or voluntary or involuntary closure of the

 

facility.
