A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding section 21525.

the people of the state of michigan enact:

Sec. 21525. (1) If a hospital conducts a drug screen to assist in diagnosing a patient's condition, the hospital shall include a test for fentanyl in that drug screen.

(2) If a drug screen under subsection (1) detects fentanyl, the hospital shall report the test result to the department of health and human services in the form and manner prescribed by the department of health and human services. The report of information under this section must not include an identifier that would make it possible to identify the individual to whom the drug screen pertains.

(3) As used in this section, "drug screen" means a chemical analysis intended to test a patient for the presence of multiple drugs, including, but not limited to, cocaine, opioids, and phencyclidine.
