A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 20206.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 20206. As permitted under the health insurance
portability and accountability act of 1996, Public Law 104-191, and
regulations promulgated under that act, 45 CFR parts 160 and 164, a
health facility or agency that provides emergency medical care
under this article shall notify local law enforcement at the time
any of the following occurs:
(a) That a patient of any age has been brought to the health
facility or agency for the treatment of a drug overdose from either
legal or illegal drugs.
(b) That a patient under the age of 21 and under the influence
of intoxicating or alcoholic liquor has been brought to the health
facility or agency for treatment.
