June 8, 2017, Introduced by Reps. Peterson, Hammoud, LaGrand, Geiss, Love, Chang, Neeley, Gay-Dagnogo, Rabhi, Sabo, Cochran, Wittenberg, Howrylak, Byrd, Sowerby, Moss, Green and Jones and referred to the Committee on Law and Justice.

 

     A bill to amend 1927 PA 175, entitled

 

"The code of criminal procedure,"

 

(MCL 760.1 to 777.69) by adding section 5 to chapter XVI.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

                             CHAPTER XVI

 

     Sec. 5. A law enforcement agency shall not adopt or implement

 

a policy that permits a peace officer to stop and search a person

 

unless that policy conforms to the following:

 

     (a) The stop is for investigative purposes and the peace

 

officer has reasonable suspicion to believe the person has been,

 

is, or is about to be engaged in criminal activity.

 

     (b) The search is of a person stopped for investigative

 

purposes and the peace officer has reasonable suspicion to believe

 

that the person is armed and dangerous.

 

     Enacting section 1. This amendatory act takes effect 90 days


after the date it is enacted into law.
