HOUSE BILL No. 4302

 

 

March 7, 2019, Introduced by Reps. Miller and Calley and referred to the Committee on Health Policy.

 

     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding section 5145.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 5145. (1) The advisory council on pediatric autoimmune

 

neuropsychiatric disorder associated with streptococcal infections

 

is created within the department.

 

     (2) The advisory council shall consist of the following 15

 

members, appointed by the director:

 

     (a) An immunologist who is practicing in this state and has

 

experience treating individuals with pediatric autoimmune

 

neuropsychiatric disorder associated with streptococcal infections

 

and pediatric acute neuropsychiatric syndrome and the use of

 

intravenous immunoglobulin.

 


     (b) A health professional who is licensed under article 15 who

 

has expertise in treating individuals with pediatric autoimmune

 

neuropsychiatric disorder associated with streptococcal infections

 

and pediatric acute neuropsychiatric syndrome and autism.

 

     (c) A representative of PANDAS/PANS Advocacy and Support.

 

     (d) A physician who is licensed under article 15 to engage in

 

the practice of osteopathic medicine and surgery who has experience

 

treating individuals with pediatric autoimmune neuropsychiatric

 

disorder associated with streptococcal infections and pediatric

 

acute neuropsychiatric syndrome.

 

     (e) A medical researcher with experience conducting research

 

concerning pediatric autoimmune neuropsychiatric disorder

 

associated with streptococcal infections, pediatric acute

 

neuropsychiatric syndrome, obsessive-compulsive disorder, tic

 

disorder, and other neurological disorders.

 

     (f) A dietitian who is practicing in this state and who

 

provides services to children with autism spectrum disorder,

 

attention-deficit hyperactivity disorder, and other neuro-

 

developmental conditions.

 

     (g) A representative of a professional organization in this

 

state for school psychologists.

 

     (h) A child psychiatrist who has experience treating

 

individuals with pediatric autoimmune neuropsychiatric disorder

 

associated with streptococcal infections and pediatric acute

 

neuropsychiatric syndrome.

 

     (i) A representative of a professional organization in this

 

state for school nurses.


     (j) A pediatrician who has experience treating individuals

 

with pediatric autoimmune neuropsychiatric disorder associated with

 

streptococcal infections and pediatric acute neuropsychiatric

 

syndrome.

 

     (k) A representative of an organization focused on autism.

 

     (l) A parent of a child who has been diagnosed with pediatric

 

autoimmune neuropsychiatric disorder associated with streptococcal

 

infections or pediatric acute neuropsychiatric syndrome and autism.

 

     (m) An individual who is licensed under article 15 as a

 

licensed master's social worker or licensed bachelor's social

 

worker.

 

     (n) A representative of the office of special education within

 

the department of education.

 

     (o) A representative of the general public.

 

     (3) The director, or his or her designee, shall serve as an ex

 

officio member of the advisory council without the right to vote.

 

     (4) The members first appointed to the advisory council shall

 

be appointed within 60 days after the effective date of this

 

section.

 

     (5) Members of the advisory council shall serve for terms of 4

 

years or until a successor is appointed, whichever is later, except

 

that of the members first appointed 5 shall serve for 1 year, 5

 

shall serve for 2 years, and 5 shall serve for 3 years.

 

     (6) If a vacancy occurs on the advisory council, the director

 

shall make an appointment for the unexpired term in the same manner

 

as the original appointment.

 

     (7) The director may remove a member of the advisory council


for incompetence, dereliction of duty, malfeasance, misfeasance, or

 

nonfeasance in office, or any other good cause.

 

     (8) The first meeting of the advisory council shall be called

 

by the director within 90 days after the effective date of this

 

section. At the first meeting, the advisory council shall elect

 

from among its members a chairperson and other officers as it

 

considers necessary or appropriate. After the first meeting, the

 

advisory council shall meet at the call of the chairperson or if

 

requested by a majority of the members of the advisory council.

 

     (9) A majority of the members of the advisory council

 

constitute a quorum for the transaction of business at a meeting of

 

the advisory council. A majority of the members present and serving

 

are required for official action of the advisory council.

 

     (10) The business that the advisory council may perform shall

 

be conducted at a public meeting of the advisory council held in

 

compliance with the open meetings act, 1976 PA 267, MCL 15.261 to

 

15.275.

 

     (11) A writing prepared, owned, used, in the possession of, or

 

retained by the advisory council in the performance of an official

 

function is subject to the freedom of information act, 1976 PA 442,

 

MCL 15.231 to 15.246.

 

     (12) Members of the advisory council shall serve without

 

compensation. However, members of the advisory council may be

 

reimbursed for their actual and necessary expenses incurred in the

 

performance of their official duties as members of the advisory

 

council.

 

     (13) By January 1, 2020, and annually thereafter, the advisory


council shall submit a report to the legislature with

 

recommendations on all of the following:

 

     (a) Practice guidelines for the diagnosis and treatment of

 

pediatric autoimmune neuropsychiatric disorder associated with

 

streptococcal infections and pediatric acute neuropsychiatric

 

syndrome.

 

     (b) Mechanisms to increase clinical awareness and education

 

regarding pediatric autoimmune neuropsychiatric disorder associated

 

with streptococcal infections and pediatric acute neuropsychiatric

 

syndrome among physicians, school-based health centers, and

 

providers of mental health services.

 

     (c) Outreach to educators and parents to increase awareness of

 

pediatric autoimmune neuropsychiatric disorder associated with

 

streptococcal infections and pediatric acute neuropsychiatric

 

syndrome.

 

     (d) Development of a network of volunteer experts on the

 

diagnosis and treatment of pediatric autoimmune neuropsychiatric

 

disorder associated with streptococcal infections and pediatric

 

acute neuropsychiatric syndrome to assist in education and

 

outreach.

 

     (e) Any other recommendation that the advisory council

 

considers appropriate.

 

     (14) As used in this section, "advisory council" means the

 

advisory council on pediatric autoimmune neuropsychiatric disorder

 

associated with streptococcal infections created in subsection (1).

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
