HOUSE BILL NO. 4100

Weiss, Breen, Tsernoglou, Arbit, Rheingans, Neeley, Young, Miller, Hood, BeGole, Posthumus, Bierlein, St. Germaine, Martin, Conlin, Neyer, Steckloff, Puri, Schuette, Hope, Zorn, Haadsma, Fox, Meerman, Johnsen, Alexander, Wozniak, Tisdel, Bezotte, Brixie, Kunse, Price, MacDonell and Whitsett and referred to the Committee on Education.

A bill to amend 2018 PA 435, entitled

"An act to create the office of school safety and prescribe its powers and duties; and to provide for the powers and duties of certain state entities,"

(MCL 28.681 to 28.683) by adding section 1a.

the people of the state of michigan enact:

Sec. 1a. As used in this act:

(a) "Department" means the department of state police.

(b) "Emergency and safety manager" means an individual described under section 1308g of the revised school code, 1976 PA 451, MCL 380.1308g.

(c) "OK2SAY program" means this state's student safety program that allows students to confidentially report tips on potential harm or criminal activities directed at students, school employees, and schools.

(d) "School" means a public, private, denominational, or parochial school offering developmental kindergarten, kindergarten, or any grade from 1 through 12, regardless of whether school is in session. School includes all school property.

(e) "School employee" means a full-time or part-time employee of a school, school district, or intermediate school district, including a school administrator, a volunteer with a school, school district, or intermediate school district, or any other individual who provides services to a school, school district, or intermediate school district while he or she is on school property. An individual described in this subdivision is considered a school employee regardless of whether school is in session.

(f) "School student" means an individual who is enrolled as a student in a school regardless of whether school is in session.

(g) "Tip" means a report or other information from the public regarding potential self-harm or harm or criminal acts directed at school students, school employees, or schools in this state, received through the OK2SAY program or a successor program, 9-1-1 system, or any other system or program used to report tips.

Enacting section 1. This amendatory act does not take effect unless all of the following bills of the 102nd Legislature are enacted into law:

(a) Senate Bill No.____ or House Bill No. 4097 (request no. 01133'23).

(b) Senate Bill No.____ or House Bill No. 4092 (request no. 01186'23).
