A bill to amend 1956 PA 40, entitled
"The drain code of 1956,"
by amending section 5 (MCL 280.5).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
5. (1) Any A
drainage district heretofore or
hereafter
established
shall be is a body corporate with power to contract, to
sue and to be sued, and to hold, manage, and dispose of real and
personal property, in addition to any other powers conferred upon
it
by law. The foregoing provision shall apply This subsection
applies to all drainage districts, regardless of when established,
including those established under chapters 20 and 21 of this act or
under
chapters 18 and 18a of Act No. 316 of the Public Acts of
1923,

(2) A drainage board under chapter 20 or 21 shall not sell,
lease, transfer, monetize, lease back, or similarly modify its
ownership interest in the assets of the drainage district unless
the action is approved by resolutions adopted by a majority of the
public corporations assessed for the drain.
