| 1 | SENATE RESOLUTION
| ||||||
| 2 | WHEREAS, 44 Ill. Admin. Part 650.240 of the Illinois | ||||||
| 3 | Administrative Code requires that a Performance Factor is to be | ||||||
| 4 | utilized when considering contractors that may be employed by | ||||||
| 5 | the State of Illinois; and
| ||||||
| 6 | WHEREAS, The Performance Factor is a numerical value which | ||||||
| 7 | is determined by the contractor's performance evaluation in a | ||||||
| 8 | work category during the previous year; at the close of each | ||||||
| 9 | construction season, the Department, other State agencies or | ||||||
| 10 | authorities using contractors based on the prequalification | ||||||
| 11 | decisions of the Department and officials of a unit of local | ||||||
| 12 | government administering a contract approved for award by the | ||||||
| 13 | Department will evaluate each contractor who performed work for | ||||||
| 14 | them during the previous year either as a prime contractor or | ||||||
| 15 | as a subcontractor; this information is submitted on the | ||||||
| 16 | Contractor's Annual Performance Report (BC-1777), and is held | ||||||
| 17 | confidential from disclosure in accordance with Section | ||||||
| 18 | 7(1)(a) of the Freedom of Information Act [5 ILCS 140/7(1)(a)]; | ||||||
| 19 | therefore, be it

| 20 | RESOLVED, BY THE SENATE OF THE ONE HUNDREDTH GENERAL | ||||||
| 21 | ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the Auditor | ||||||

| 23 | Transportation's compliance with 44 Ill. Admin. Part 650.240 of | ||||||
