Bill Title: Amends the Counties Code. Allows a county to establish standards for the construction of data centers by ordinance. Provides that the standards may include, without limitation, the size, height, and design of structures and the number of facilities that may be located within a geographic area. Provides that a county may regulate the siting of data centers in unincorporated areas of the county outside of the zoning jurisdiction of a municipality and the 1.5-mile radius surrounding the zoning jurisdiction of a municipality and may establish other specified standards. Sets forth provisions concerning notice and hearings. Provides that any provision of a county zoning ordinance pertaining to data centers that is in effect prior to the effective date may remain in effect. Amends the Illinois Municipal Code. Provides that a municipality may, by ordinance, regulate the siting of data centers within the municipality's zoning jurisdiction and within the 1.5-mile radius surrounding its zoning jurisdiction and may establish other specified standards. Sets forth provisions concerning notice and hearings.

| 1 | AN ACT concerning local government. | |||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||||
| 4 | Section 5. The Counties Code is amended by adding Section | |||||||||||||||||||||
| 5 | 5-12025 as follows: | |||||||||||||||||||||
| 6 | (55 ILCS 5/5-12025 new) | |||||||||||||||||||||
| 7 | Sec. 5-12025. Data centers. | |||||||||||||||||||||
| 8 | (a) For the purposes of this Section, "data center" means | |||||||||||||||||||||
| 9 | a facility: (1) whose primary services are the storage, | |||||||||||||||||||||
| 10 | management, and processing of digital data; and (2) that is | |||||||||||||||||||||
| 11 | used to house (i) computer and network systems, including | |||||||||||||||||||||
| 12 | associated components such as servers, network equipment and | |||||||||||||||||||||
| 13 | appliances, telecommunications, and data storage systems, (ii) | |||||||||||||||||||||
| 14 | systems for monitoring and managing infrastructure | |||||||||||||||||||||
| 15 | performance, (iii) Internet-related equipment and services, | |||||||||||||||||||||
| 16 | (iv) data communications connections, (v) environmental | |||||||||||||||||||||
| 17 | controls, (vi) fire protection systems, and (vii) security | |||||||||||||||||||||
| 18 | systems and services. | |||||||||||||||||||||
| 19 | (b) A county may, by ordinance, establish standards for | |||||||||||||||||||||
| 20 | the construction of data centers. The standards may include, | |||||||||||||||||||||
| 21 | without limitation, the size, height, and design of structures | |||||||||||||||||||||
| 22 | and the number of facilities that may be located within a | |||||||||||||||||||||
| 23 | geographic area. A county may also regulate the siting of data | |||||||||||||||||||||

| 1 | centers in unincorporated areas of the county outside of the | ||||||
| 2 | zoning jurisdiction of a municipality and the 1.5-mile radius | ||||||
| 3 | surrounding the zoning jurisdiction of a municipality. A | ||||||
| 4 | county may not allow the siting of a data center within 3 miles | ||||||
| 5 | of the corporate boundaries of another municipality unless the | ||||||
| 6 | corporate authorities of that municipality have granted prior | ||||||
| 7 | written consent. A county may establish additional standards | ||||||
| 8 | for data centers to protect the availability, sustainability, | ||||||
| 9 | and purity of water and other water resources, including | ||||||
| 10 | limitations on water withdrawal, requirements for water reuse | ||||||
| 11 | or conservation systems, and safeguards to prevent | ||||||
| 12 | contamination. A county may also establish additional | ||||||
| 13 | standards to mitigate noise pollution. | ||||||
| 14 | (c) There shall be at least one public hearing not more | ||||||
| 15 | than 30 days prior to a siting decision by the county board. | ||||||
| 16 | Notice of the hearing shall be published in a newspaper of | ||||||
| 17 | general circulation in the county. | ||||||
| 18 | (d) Notwithstanding any requirements of this Section, any | ||||||
| 19 | provision of a county zoning ordinance pertaining to data | ||||||
| 20 | centers that is in effect prior to the effective date of this | ||||||
| 21 | amendatory Act of the 104th General Assembly may remain in | ||||||
| 22 | effect. | ||||||
| 23 | Section 10. The Illinois Municipal Code is amended by | ||||||
| 24 | adding Section 11-13-30 as follows: | ||||||
