Bill Title: Amends the Counties Code. Allows a county to establish standards for the construction of data centers by ordinance. Provides that the standards may include, without limitation, the size, height, and design of structures and the number of facilities that may be located within a geographic area. Provides that a county may regulate the siting of data centers in unincorporated areas of the county outside of the zoning jurisdiction of a municipality and the 1.5-mile radius surrounding the zoning jurisdiction of a municipality and may establish other specified standards. Sets forth provisions concerning notice and hearings. Provides that any provision of a county zoning ordinance pertaining to data centers that is in effect prior to the effective date may remain in effect. Amends the Illinois Municipal Code. Provides that a municipality may, by ordinance, regulate the siting of data centers within the municipality's zoning jurisdiction and within the 1.5-mile radius surrounding its zoning jurisdiction and may establish other specified standards. 1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-12025 as follows:
 
6    (55 ILCS 5/5-12025 new)
7    Sec. 5-12025. Data centers.
8    (a) For the purposes of this Section, "data center" means
9a facility: (1) whose primary services are the storage,
10management, and processing of digital data; and (2) that is
11used to house (i) computer and network systems, including
12associated components such as servers, network equipment and
13appliances, telecommunications, and data storage systems, (ii)
14systems for monitoring and managing infrastructure
15performance, (iii) Internet-related equipment and services,
16(iv) data communications connections, (v) environmental
17controls, (vi) fire protection systems, and (vii) security
18systems and services.    
19    (b) A county may, by ordinance, establish standards for
20the construction of data centers. The standards may include,
21without limitation, the size, height, and design of structures
22and the number of facilities that may be located within a
23geographic area. A county may also regulate the siting of data

1centers in unincorporated areas of the county outside of the
2zoning jurisdiction of a municipality and the 1.5-mile radius
3surrounding the zoning jurisdiction of a municipality. A
4county may not allow the siting of a data center within 3 miles
5of the corporate boundaries of another municipality unless the
6corporate authorities of that municipality have granted prior
7written consent. A county may establish additional standards
8for data centers to protect the availability, sustainability,
9and purity of water and other water resources, including
10limitations on water withdrawal, requirements for water reuse
11or conservation systems, and safeguards to prevent
12contamination. A county may also establish additional
13standards to mitigate noise pollution.
14    (c) There shall be at least one public hearing not more
15than 30 days prior to a siting decision by the county board.
16Notice of the hearing shall be published in a newspaper of
17general circulation in the county.    
18    (d) Notwithstanding any requirements of this Section, any
19provision of a county zoning ordinance pertaining to data
20centers that is in effect prior to the effective date of this
21amendatory Act of the 104th General Assembly may remain in
22effect.
 
23    Section 10. The Illinois Municipal Code is amended by
24adding Section 11-13-30 as follows:
