Bill Title: Amends the Counties Code. Provides that a sheriff's salary in a non-home rule county shall not be less than 80% of the State's Attorney salary for the county in which the sheriff is elected or appointed. Defines "salary". Provides that the State shall furnish 66 2/3% and the county 33 1/3% of the total annual salary to be paid to a sheriff. Prevents a county from decreasing the salary of a sheriff who earns more than 80% of the State's Attorney's salary on the effective date of the amendatory Act. Effective immediately.

1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Counties Code is amended by adding Section | ||||||||||||||||||||||||
5 | 3-6007.5 as follows:

6 | (55 ILCS 5/3-6007.5 new) | ||||||||||||||||||||||||
7 | Sec. 3-6007.5. Sheriff's salary. | ||||||||||||||||||||||||
8 | (a) As used in this Section, "salary" is exclusive of any | ||||||||||||||||||||||||
9 | other compensation or benefits. | ||||||||||||||||||||||||
10 | (b) The salary of the sheriff in a non-home rule county | ||||||||||||||||||||||||
11 | shall not be less than 80% of the salary set for the State's | ||||||||||||||||||||||||
12 | Attorney under Section 4-2001 for the county in which the | ||||||||||||||||||||||||
13 | sheriff is elected or appointed. | ||||||||||||||||||||||||
14 | (c) The State shall furnish 66 2/3% of the total annual | ||||||||||||||||||||||||
15 | salary to be paid to a sheriff. Said amounts furnished by the | ||||||||||||||||||||||||
16 | State shall be payable monthly by the Department of Revenue | ||||||||||||||||||||||||
17 | out of the Personal Property Tax Replacement Fund or the | ||||||||||||||||||||||||
18 | General Revenue Fund to the county in which the sheriff is | ||||||||||||||||||||||||
19 | elected or appointed. The county shall furnish 33 1/3% of the | ||||||||||||||||||||||||
20 | total annual salary. | ||||||||||||||||||||||||
21 | (d) If, on the effective date of this amendatory Act of the | ||||||||||||||||||||||||
22 | 102nd General Assembly, the salary of a sheriff is greater | ||||||||||||||||||||||||
23 | than 80% of the State's Attorney's salary under Section 4-2001 |

2 | that sheriff's salary shall not be reduced.

3 | Section 99. Effective date. This Act takes effect upon | ||||||
4 | becoming law.
