Bill Title: Creates the Child Trauma Counseling Act. Defines terms. Provides that: (1) a day care center shall provide the services of a trauma counselor to a child, from birth through the fifth grade, enrolled and attending the day care center who has been identified as needing trauma counseling; and (2) a school shall provide the services of a trauma counselor to a child who is enrolled and attending Kindergarten through the fifth grade at that school and has been identified as needing trauma counseling. Provides that there shall be no cost for such trauma counseling to the parents or guardians of the child. Provides that a child is identified as needing trauma counseling if the child reports trauma to a day care center or a school or a parent or guardian of a child or employee of a day care center or a school reports that the child has experienced trauma. Provides for the adoption of rules to implement the Act and rules related to qualifications of trauma counselors working with children under the Act. Amends the State Mandates Act to require implementation without reimbursement.

1 | AN ACT concerning counseling.
| ||||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 1. Short title. This Act may be cited as the Child | ||||||||||||||||||||||||||
5 | Trauma Counseling Act.

6 | Section 5. Definitions. As used in this Act: | ||||||||||||||||||||||||||
7 | "Day care center" has the meaning given to that term in | ||||||||||||||||||||||||||
8 | Section 2.09 of the Child Care Act of 1969. | ||||||||||||||||||||||||||
9 | "School" means a public or nonpublic elementary school. | ||||||||||||||||||||||||||
10 | "Trauma counselor" means a licensed professional | ||||||||||||||||||||||||||
11 | counselor, as that term is defined in Section 10 of the | ||||||||||||||||||||||||||
12 | Professional Counselor and Clinical Professional Counselor | ||||||||||||||||||||||||||
13 | Licensing and Practice Act, with experience in treating | ||||||||||||||||||||||||||
14 | childhood trauma or who has a certification relating to | ||||||||||||||||||||||||||
15 | treating childhood trauma.

16 | Section 10. Trauma counseling through fifth grade.

17 | (a) Notwithstanding any other provision of law: | ||||||||||||||||||||||||||
18 | (1) a day care center shall provide the services of a | ||||||||||||||||||||||||||
19 | trauma counselor to a child, from birth through the fifth | ||||||||||||||||||||||||||
20 | grade, enrolled and attending the day care center who has | ||||||||||||||||||||||||||
21 | been identified as needing trauma counseling; and | ||||||||||||||||||||||||||
22 | (2) a school shall provide the services of a trauma |

8 | center or a school or a parent or guardian of the child or | ||||||

10 | child has experienced trauma.

11 | Section 15. Rules. | ||||||
12 | (a) The Department of Children and Family Services shall | ||||||
13 | adopt rules to implement this Act. The Department shall seek | ||||||
14 | recommendations and advice from the State Board of Education as | ||||||
15 | to adoption of the Department's rules as they relate to | ||||||
16 | schools. | ||||||
17 | (b) The Department of Financial and Professional | ||||||
18 | Regulation may adopt rules regarding the qualifications of | ||||||
19 | trauma counselors working with children under this Act.

20 | Section 90. The State Mandates Act is amended by adding | ||||||
21 | Section 8.44 as follows:

23 | Sec. 8.44. Exempt mandate. Notwithstanding Sections 6 and 8 |

1 | of this Act, no reimbursement by the State is required for the | ||||||
2 | implementation of any mandate created by this amendatory Act of | ||||||
3 | the 101st General Assembly.
