Bill Title: Amends the Election Code. Requires each candidate to provide to the Board of Elections a notarized certification that he or she has not been convicted of tax fraud and has not been found by any taxing body or court to have intentionally engaged in an act or acts of fraud, deceit, or misrepresentation to achieve a reduction in the amount of taxes due or to avoid paying taxes that would otherwise be owed. Provides that State Board of Elections shall not certify the name of any person who (i) has not filed the certification or (ii) has been convicted of tax fraud or has been found by any taxing body or other unit of government to have intentionally engaged in an act or acts of fraud, deceit, or misrepresentation to achieve a reduction in the amount of taxes due or to avoid paying taxes that would otherwise be owed. Requires the State Board of Elections to generate a list of all such candidates and transmit that list to the election authority.

SYNOPSIS AS INTRODUCED:
10 ILCS 5/1-18 new

Amends the Election Code. 1 AN ACT concerning elections.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Election Code is amended by adding Section
51-18 as follows:
6 (10 ILCS 5/1-18 new)
7 Sec. 1-18. Ballot forfeiture; indebtedness.
8 (a) No later than 30 days before the date required for
9certification, each candidate shall provide to the Board of
10Elections a notarized certification, sworn under penalty of
11perjury, that he or she has not been convicted of tax fraud and
12has not been found by any taxing body or court to have
13intentionally engaged in an act or acts of fraud, deceit, or
14misrepresentation to achieve a reduction in the amount of taxes
15due or to avoid paying taxes that would otherwise be owed.
16 (b) The State Board of Elections shall not certify the name
17of any person who (i) has not filed the certification required
18by subsection (a) or (ii) has been convicted of tax fraud or
19has been found by any taxing body or other unit of government
20to have intentionally engaged in an act or acts of fraud,
21deceit, or misrepresentation to achieve a reduction in the
22amount of taxes due or to avoid paying taxes that would
23otherwise be owed.

1 (c) The State Board of Elections shall generate a list of
2all candidates specified in subsection (b). Such list shall be
3transmitted to any election authority whose duty it is to place
4the name of any such candidate on the ballot. The election
5authority shall not place upon the ballot the name of any
6candidate who has been convicted of tax fraud or who has been
7found by any taxing body or other unit of government to have
8intentionally engaged in an act or acts of fraud, deceit, or
9misrepresentation to achieve a reduction in the amount of taxes
10due or to avoid paying taxes that would otherwise be owed.
