AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Counties Code is amended by adding Section
5-1134 as follows:
(55 ILCS 5/5-1134 new)
Sec. 5-1134. Use of coal tar. The county board or board of
county commissioners of a county may prohibit the use of coal
tar pavement products on all roadways, driveways, and parking
lots within the county. For the purposes of this Section, "coal
tar" means a viscous substance obtained by the combustion of
coal and containing levels of polycyclic aromatic hydrocarbons
in excess of 10,000 milligrams per kilogram. "Coal tar"
includes, but is not limited to, refined coal tar, high
temperature coal tar, or coal tar pitch. "Coal tar" does not
include any substance listed under Sections 3.135 or 3.140 of
the Environmental Protection Act. "Coal tar pavement product"
means a material that contains coal tar that is intended for
use as a pavement sealant.
