Bill Title: Amends the Criminal Code of 2012. Provides that obstructing justice in furtherance of, or to avoid the consequences arising from, a: (1) Class X felony or first degree murder is a Class 1 felony; (2) Class 1 felony is a Class 2 felony; and (3) Class 2 felony is a Class 3 felony.

| 1 | AN ACT concerning criminal law.
| ||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
| 3 | represented in the General Assembly:
| ||||||||||||||||||||||||
| 4 | Section 5. The Criminal Code of 2012 is amended by changing | ||||||||||||||||||||||||
| 5 | Section 31-4 as follows:
| ||||||||||||||||||||||||
| 6 | (720 ILCS 5/31-4) (from Ch. 38, par. 31-4)
| ||||||||||||||||||||||||
| 7 | Sec. 31-4. Obstructing justice.
| ||||||||||||||||||||||||
| 8 | (a) A person obstructs justice when, with intent to prevent | ||||||||||||||||||||||||
| 9 | the apprehension
or obstruct the prosecution or defense of any | ||||||||||||||||||||||||
| 10 | person, he or she knowingly commits
any of the following acts:
| ||||||||||||||||||||||||
| 11 | (1) Destroys, alters, conceals or disguises physical | ||||||||||||||||||||||||
| 12 | evidence, plants
false evidence, furnishes false | ||||||||||||||||||||||||
| 13 | information; or
| ||||||||||||||||||||||||
| 14 | (2) Induces a witness having knowledge material to the | ||||||||||||||||||||||||
| 15 | subject at issue
to leave the State or conceal himself or | ||||||||||||||||||||||||
| 16 | herself; or
| ||||||||||||||||||||||||
| 17 | (3) Possessing knowledge material to the subject at | ||||||||||||||||||||||||
| 18 | issue, he or she leaves the
State or conceals himself; or | ||||||||||||||||||||||||
| 19 | (4) If a parent, legal guardian, or caretaker
of a | ||||||||||||||||||||||||
| 20 | child under 13 years of age reports materially false | ||||||||||||||||||||||||
| 21 | information to a law enforcement agency, medical examiner, | ||||||||||||||||||||||||
| 22 | coroner, State's Attorney, or other governmental agency | ||||||||||||||||||||||||
| 23 | during an investigation of the disappearance or death of a | ||||||||||||||||||||||||
| |||||||
| |||||||
| 1 | child under circumstances described in subsection (a) or | ||||||
| 2 | (b) of Section 10-10 of this Code.
| ||||||
| 3 | (b) Sentence.
| ||||||
| 4 | (1) Obstructing justice is a Class 4 felony, except as | ||||||
| 5 | provided in
paragraph (2) or (3) of this subsection (b).
| ||||||
| 6 | (2) Obstructing justice in furtherance of streetgang | ||||||
| 7 | related or
gang-related activity, as defined in Section 10 | ||||||
| 8 | of the Illinois Streetgang
Terrorism Omnibus Prevention | ||||||
| 9 | Act, is a Class 3 felony.
| ||||||
| 10 | (3) Obstructing justice in furtherance of, or to avoid | ||||||
| 11 | the consequences arising from, a: | ||||||
| 12 | (A) Class X felony or first degree murder is a | ||||||
| 13 | Class 1 felony. | ||||||
| 14 | (B) Class 1 felony is a Class 2 felony. | ||||||
| 15 | (C) Class 2 felony is a Class 3 felony. | ||||||
