Bill Title: Amends the Illinois Vehicle Code. Creates the Randall Road bus on shoulder pilot program. Provides that commencing on the effective date of this Act, the Department, in cooperation with the Regional Transportation Authority, the Suburban Bus Division of the Regional Transportation Authority, and the Illinois State Police, shall establish a 5-year pilot program on the Randall Road corridor in Kane County for the use of transit busses on highways and shoulders. Provides that the Department may adopt rules as necessary to implement the pilot program, and that the Department shall present to the General Assembly a report on the effectiveness of the program 2 years into the 5-year pilot program. Effective immediately.

| 1 | AN ACT concerning transportation.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Illinois Vehicle Code is amended by changing | ||||||
| 5 | Section 11-709.2 and by adding Section 11-709.4 as follows:
| ||||||
| 6 | (625 ILCS 5/11-709.2) | ||||||
| 7 | Sec. 11-709.2. Bus on shoulder pilot program. | ||||||
| 8 | (a) For purposes of this Section, "bus on shoulders" is the | ||||||
| 9 | use of specifically designated shoulders of roadways by | ||||||
| 10 | authorized transit buses. The shoulders may be used by transit | ||||||
| 11 | buses at times and locations as set by the Department in | ||||||
| 12 | cooperation with the Regional Transportation Authority and the | ||||||
| 13 | Suburban Bus Division of the Regional Transportation | ||||||
| 14 | Authority. | ||||||
| 15 | (b) Commencing on the effective date of this amendatory Act | ||||||
| 16 | of the 97th General Assembly, the Department along with the | ||||||
| 17 | Regional Transportation Authority and Suburban Bus Division of | ||||||
| 18 | the Regional Transportation Authority in cooperation with the | ||||||
| 19 | Illinois State Police shall establish a 5-year pilot program | ||||||
| 20 | within the boundaries of the Regional Transportation Authority | ||||||
| 21 | for transit buses on highways and shoulders. The pilot program | ||||||
| 22 | may be implemented on shoulders of highways as designated by | ||||||
| 23 | the Department in cooperation with the Regional Transportation | ||||||

| 1 | Authority and Suburban Bus Division of the Regional | ||||||
| 2 | Transportation Authority and any affected local highway | ||||||
| 3 | authorities. The Department may adopt rules necessary for | ||||||
| 4 | approving, establishing, operating, evaluating, and reporting | ||||||
| 5 | on the pilot program for transit buses to use roadway | ||||||
| 6 | shoulders. | ||||||
| 7 | (c) After the pilot program established under subsection | ||||||
| 8 | (b) of this Section has been operating for 2 years, the | ||||||
| 9 | Department in cooperation with the Regional Transit Authority, | ||||||
| 10 | the Suburban Bus Division of the Regional Transportation | ||||||
| 11 | Authority, and the Illinois State Police shall issue a report | ||||||
| 12 | to the General Assembly on the effectiveness of the bus on | ||||||
| 13 | shoulders pilot program.

The pilot program is subject to appropriation and | ||||||

| 12 | Transportation Authority, and the Kane County Division of | ||||||
| 13 | Transportation.
