Bill Title: Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services shall by rule establish the drugs, excluding clotting factor, required to be dispensed in the Department's pharmacy specialty drugs program (rather than the Department shall by rule establish the drugs required to be dispensed in the Department's pharmacy specialty drugs program).

| 2 | AMENDMENT NO. ______. Amend Senate Bill 3213, AS AMENDED, | ||||||
| 3 | as follows:

| 4 | immediately below Section 5, by inserting the following:
| ||||||
| 5 | "Section 10. The Hemophilia Care Act is amended by changing | ||||||
| 6 | Section 3 as follows:
| ||||||
| 7 | (410 ILCS 420/3) (from Ch. 111 1/2, par. 2903)
| ||||||
| 8 | Sec. 3. The powers and duties of the Department shall | ||||||
| 9 | include the following:
| ||||||
| 10 | (1) With the advice and counsel of the Committee, develop | ||||||
| 11 | standards for
determining eligibility for care and treatment | ||||||
| 12 | under this program. Among
other standards developed under this | ||||||
| 13 | Section, persons suffering from hemophilia
must be evaluated in | ||||||
| 14 | a center properly staffed and equipped for such
evaluation,
but | ||||||
| 15 | not operated by the Department.

| |||||||
| 1 | (2) (Blank).
| ||||||
| 2 | (3) Extend financial assistance to eligible persons in | ||||||
| 3 | order that they
may obtain blood and blood derivatives for use | ||||||
| 4 | in hospitals, in medical
and dental facilities, or at home. The | ||||||
| 5 | Department shall extend financial
assistance in each fiscal | ||||||
| 6 | year to each family containing one or more eligible
persons in | ||||||
| 7 | the amount of (a) the family's eligible cost of hemophilia | ||||||
| 8 | services
for that fiscal year, minus (b) one fifth of its | ||||||
| 9 | available family income
for its next preceding taxable year. | ||||||
| 10 | The Director may extend
financial
assistance in the case of | ||||||
| 11 | unusual hardships, according to specific procedures
and | ||||||
| 12 | conditions adopted for this purpose in the rules and | ||||||
| 13 | regulations
promulgated
by the Department to implement and | ||||||
| 14 | administer this Act.
| ||||||
| 15 | (3.5) Extend financial assistance to eligible persons to | ||||||
| 16 | help subsidize the cost of health insurance premiums, including | ||||||
| 17 | Medicare Part B premiums under the Medicare Buy-In process and | ||||||
| 18 | continuation coverage premiums under the Consolidated Omnibus | ||||||
| 19 | Budget Reconciliation Act of 1985 (COBRA). The assistance | ||||||
| 20 | authorized by this item (3.5) shall only be available upon | ||||||
| 21 | confirmation by the Department that such assistance is more | ||||||
| 22 | cost effective than providing other assistance authorized | ||||||
| 23 | under this Act. | ||||||
| 24 | (4) (Blank).

| 25 | (5) Promulgate rules and regulations with the advice and | ||||||
| 26 | counsel of the
Committee for the implementation and | ||||||

| |||||||
| 1 | administration of this Act.
