Bill Title: Amends the Illinois Public Aid Code. Provides that grant amounts under the Temporary Assistance for Needy Families (TANF) program may not vary on the basis of a TANF recipient's county of residence. Increases TANF grant amounts to: 30% of federal poverty guidelines beginning October 1, 2018; 40% of federal poverty guidelines beginning October 1, 2019; and 50% of federal poverty guidelines beginning October 1, 2020. Provides that beginning October 1, 2021, and each October 1 thereafter, TANF grant amounts shall be annually adjusted to remain equal to 50% of the most recent federal poverty guidelines for each family size. Provides that TANF grants for child-only assistance units shall be at least 75% of TANF grants for assistance units of the same size that consist of a caretaker relative with children. Effective immediately.

1 AN ACT concerning public aid.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5changing Section 12-4.11 as follows:
6 (305 ILCS 5/12-4.11) (from Ch. 23, par. 12-4.11)
7 Sec. 12-4.11. Grant amounts. The Department, with due
8regard for and subject to budgetary limitations, shall
9establish grant amounts for each of the programs, by
10regulation. The grant amounts may vary by program, size of
11assistance unit and geographic area. Grant amounts under the
12Temporary Assistance for Needy Families (TANF) program may not
13vary on the basis of a TANF recipient's county of residence.
14 Aid payments shall not be reduced except: (1) for changes
15in the cost of items included in the grant amounts, or (2) for
16changes in the expenses of the recipient, or (3) for changes in
17the income or resources available to the recipient, or (4) for
18changes in grants resulting from adoption of a consolidated
19grant amount.
20 The maximum benefit levels provided to TANF recipients
21shall increase according to the following schedule: (A)
22beginning October 1, 2018, the Department of Human Services
23shall increase TANF grant amounts in effect on September 30,

12018 to 30% of the most recent United States Department of
2Health and Human Services Federal Poverty Guidelines for each
3family size; (B) beginning October 1, 2019, the Department of
4Human Services shall increase TANF grant amounts in effect on
5September 30, 2019 to 40% of the most recent United States
6Department of Health and Human Services Federal Poverty
7Guidelines for each family size; (C) beginning October 1, 2020,
8the Department of Human Services shall increase TANF grant
9amounts in effect on September 30, 2020 to 50% of the most
10recent United States Department of Health and Human Services
11Federal Poverty Guidelines for each family size; and (D)
12beginning October 1, 2021 and each October 1 thereafter, the
13maximum benefit levels shall be annually adjusted to remain
14equal to 50% of the most recent United States Department of
15Health and Human Services Federal Poverty Guidelines for each
16family size.
17 TANF grants for child-only assistance units shall be at
18least 75% of TANF grants for assistance units of the same size
19that consist of a caretaker relative with children.
20 Subject to appropriation, beginning on July 1, 2008, the
21Department of Human Services shall increase TANF grant amounts
22in effect on June 30, 2008 by 15%. The Department is authorized
23to administer this increase but may not otherwise adopt any
24rule to implement this increase.
25 In fixing standards to govern payments or reimbursements
26for funeral and burial expenses, the Department shall establish

1a minimum allowable amount of not less than $1,000 for
2Department payment of funeral services and not less than $500
3for Department payment of burial or cremation services. On
4January 1, 2006, July 1, 2006, and July 1, 2007, the Department
5shall increase the minimum reimbursement amount for funeral and
6burial expenses under this Section by a percentage equal to the
7percentage increase in the Consumer Price Index for All Urban
8Consumers, if any, during the 12 months immediately preceding
9that January 1 or July 1. In establishing the minimum allowable
10amount, the Department shall take into account the services
11essential to a dignified, low-cost (i) funeral and (ii) burial
12or cremation, including reasonable amounts that may be
13necessary for burial space and cemetery charges, and any
14applicable taxes or other required governmental fees or
15charges. If no person has agreed to pay the total cost of the
16(i) funeral and (ii) burial or cremation charges, the
17Department shall pay the vendor the actual costs of the (i)
18funeral and (ii) burial or cremation, or the minimum allowable
19amount for each service as established by the Department,
20whichever is less, provided that the Department reduces its
21payments by the amount available from the following sources:
22the decedent's assets and available resources and the
23anticipated amounts of any death benefits available to the
24decedent's estate, and amounts paid and arranged to be paid by
25the decedent's legally responsible relatives. A legally
26responsible relative is expected to pay (i) funeral and (ii)

1burial or cremation expenses unless financially unable to do
2so.
3 Nothing contained in this Section or in any other Section
4of this Code shall be construed to prohibit the Illinois
5Department (1) from consolidating existing standards on the
6basis of any standards which are or were in effect on, or
7subsequent to July 1, 1969, or (2) from employing any
8consolidated standards in determining need for public aid and
9the amount of money payment or grant for individual recipients
10or recipient families.

13 Section 99. Effective date. This Act takes effect upon
14becoming law.
