Bill Title: Amends the Humane Care for Animals Act. Provides that companion animal euthanasia chambers must allow for the separation of animals. Removes a provision requiring only one companion animal to be euthanized at a time. Requires veterinarians to use professional judgment when deciding whether or not a procedure shall involve the euthanasia of a single animal or multiple animals, taking into consideration the safety of facility staff and the most humane practices. Effective immediately.

1 AN ACT concerning animals.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Humane Care for Animals Act is amended by
5 changing Section 3.09 as follows:
6 (510 ILCS 70/3.09)
7 Sec. 3.09. Carbon monoxide euthanasia by a licensed
8 veterinarian. A licensed veterinarian may euthanize a
9 companion animal in a commercially manufactured chamber by use
10 of compressed carbon monoxide. The veterinarian must be
11 physically present during the euthanasia process until death is
12 confirmed. The veterinarian must take all of the following
13 steps when using a gas chamber:
14 (1) Render a written opinion for each companion animal
15 including:
16 (A) a description of the animal including species,
17 color, age, sex, and microchip number if present; and
18 (B) a signed and dated statement that the use of
19 compressed carbon monoxide is the most humane method of
20 euthanasia for this companion animal.
21 (2) Use a commercially manufactured chamber pursuant
22 to the guidelines set forth in the most recent report of
23 the AVMA Panel on Euthanasia. The interior of the chamber

1 must be well lit, allow for separation of animals, and be
2 equipped with view-ports, a regulator, and a flow meter.
3 Monitoring equipment must be used at all times during the
4 operation. Animals that are under 4 months of age, old,
5 injured, or sick may not be euthanized by carbon monoxide.
6 Animals shall remain in the chamber and be exposed for a
7 minimum of 20 minutes. Staff members shall be fully
8 notified of potential health risks.
9 (3) (Blank) Only one companion animal may be euthanized
10 at a time.
11 (4) Use professional judgment when deciding whether or
12 not a procedure shall involve the euthanasia of a single
13 animal or multiple animals, taking into consideration the
14 safety of facility staff and the most humane practices.

16 Section 99. Effective date. This Act takes effect upon
17 becoming law.
