| 1 | AN ACT concerning local government.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 5. The Illinois Municipal Code is amended by | |||||||||||||||||||
| 5 | changing Section 10-1-18.2 as follows:
| |||||||||||||||||||
| 6 | (65 ILCS 5/10-1-18.2) (from Ch. 24, par. 10-1-18.2)
| |||||||||||||||||||
| 7 | Sec. 10-1-18.2. Home rule preemption. No municipality, | |||||||||||||||||||
| 8 | including a
municipality that is a home rule unit, may regulate | |||||||||||||||||||
| 9 | the the period of time or
establish or enforce a statute of | |||||||||||||||||||
| 10 | limitations relating to charges brought
against a police | |||||||||||||||||||
| 11 | officer before a Police Board, Civil Service Commission, or
| |||||||||||||||||||
| 12 | other board or officer empowered by law or ordinance to | |||||||||||||||||||
| 13 | investigate police
misconduct if the charge is based upon an | |||||||||||||||||||
| 14 | allegation of the use of unreasonable
force by a police | |||||||||||||||||||
| 15 | officer. The statute of limitations established in Sections
| |||||||||||||||||||
| 16 | 10-1-18 and 10-1-18.1 for those charges are an exclusive | |||||||||||||||||||
| 17 | exercise of powers and
functions by the State under paragraph | |||||||||||||||||||
| 18 | (h) of Section 6 of Article VII of the
Illinois Constitution.
