| 1 | AN ACT concerning employment.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 5. The Employee Benefit Contribution Act is amended | |||||||||||||||||||
| 5 | by changing Section 2 as follows:
| |||||||||||||||||||
| 6 | (820 ILCS 160/2) (from Ch. 48, par. 39x)

| 7 | Sec. 2.
Any employer who has agreed to make payments to an | |||||||||||||||||||
| 8 | employee
health insurance plan shall notify its employees of | |||||||||||||||||||
| 9 | any failure to make
such payments where such failure shall | |||||||||||||||||||
| 10 | result in the
the total
loss of insurance coverage
so as to | |||||||||||||||||||
| 11 | provide its employees a reasonable opportunity to replace such
| |||||||||||||||||||
| 12 | coverage at the time the employee health insurance plan | |||||||||||||||||||
| 13 | terminates.
The employer must provide written notification | |||||||||||||||||||
| 14 | directly to each of its
employees who
are covered under the | |||||||||||||||||||
| 15 | plan. Any employer who fails to provide timely notice of a
| |||||||||||||||||||
| 16 | prospective
termination of a health insurance plan, which | |||||||||||||||||||
| 17 | failure results in the
deprivation
of the opportunity to | |||||||||||||||||||
| 18 | replace such coverage and which further results in
damages to | |||||||||||||||||||
| 19 | one or more employees arising from the loss of coverage,
shall | |||||||||||||||||||
| 20 | be guilty of a Class B misdemeanor. | |||||||||||||||||||
