Bill Title: Amends the Illinois Health Facilities Planning Act. Provides that the annual report of capital expenditures submitted to the Health Facilities and Services Review Board by certain health care facilities shall include (i) whether the health care facility administered an affirmative action program for minority-owned, women-owned, veteran-owned, and small business enterprises and (ii) the percentage of the annual capital expenditure that was actually spent on minority-owned, women-owned, veteran-owned, and small business enterprises, respectively. Provides that the Board shall not consider that information when reviewing an application for a permit or exemption under the Act. Effective immediately.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Department of Public Health Powers and | ||||||
| 5 | Duties Law of the
Civil Administrative Code of Illinois is | ||||||
| 6 | amended by adding Section 2310-685 as follows:
| ||||||
| 7 | (20 ILCS 2310/2310-685 new) | ||||||
| 8 | Sec. 2310-685. Health care facility; policy to encourage | ||||||
| 9 | participation in capital projects. | ||||||
| 10 | (a) A health care facility shall develop a policy to | ||||||
| 11 | encourage the participation of minority-owned, women-owned, | ||||||
| 12 | veteran-owned, and small business enterprises in capital | ||||||
| 13 | projects undertaken by the health care facility. | ||||||
| 14 | (b) A health care system may develop a system-wide policy | ||||||
| 15 | in order to comply with the requirement of subsection (a) of | ||||||
| 16 | this Section. | ||||||
| 17 | (c) The policy required under this Section must be | ||||||
| 18 | developed no later than 6 months after the effective date of | ||||||
| 19 | this amendatory Act of the 98th General Assembly. | ||||||
| 20 | (d) This Section does not apply to health care facilities | ||||||
| 21 | with 100 or fewer beds, health care facilities located in a | ||||||
| 22 | county with a total census population of less than 3,000,000, | ||||||
| 23 | or health care facilities owned or operated by a unit of local | ||||||
| |||||||
| |||||||
| 1 | government or the State or federal government. | ||||||
| 2 | (e) For the purpose of this Section, "health care facility" | ||||||
| 3 | has the same meaning as set forth in the Illinois Health | ||||||
| 4 | Facilities Planning Act.
