Bill Title: Amends the State Finance Act. Creates the Cook County Water Infrastructure Fund as a special fund in the State treasury. Provides that, subject to appropriation, moneys in the Fund shall be used by the Environmental Protection Agency to make grants to municipalities to fund infrastructure improvements to facilitate water supplies from Lake Michigan for residents of Cook County. Provides that, in making grants from the Cook County Water Infrastructure Fund, the Agency must prioritize water infrastructure projects in non-supplying municipalities in Cook County over water infrastructure projects in supplying municipalities in Cook County. Defines terms. Effective immediately.

| 1 | AN ACT concerning finance.

| 2 | Be it enacted by the People of the State of Illinois,

| 3 | represented in the General Assembly:

| 4 | Section 5. The State Finance Act is amended by adding | ||||||||||||||||||||||||||
| 5 | Section 5.935 and 6z-124 as follows:

| 6 | (30 ILCS 105/5.935 new) | ||||||||||||||||||||||||||
| 7 | Sec. 5.935. The Cook County Water Infrastructure Fund.

| 8 | (30 ILCS 105/6z-124 new) | ||||||||||||||||||||||||||
| 9 | Sec. 6z-124. Water supplies from Lake Michigan. | ||||||||||||||||||||||||||
| 10 | (a) As used in this Section: | ||||||||||||||||||||||||||
| 11 | "Non-supplying municipality in Cook County" means a | ||||||||||||||||||||||||||
| 12 | municipality in Cook County that receives its water from | ||||||||||||||||||||||||||
| 13 | another municipality and does not sell its water to another | ||||||||||||||||||||||||||
| 14 | municipality. | ||||||||||||||||||||||||||
| 15 | "Supplying municipality in Cook County" means a | ||||||||||||||||||||||||||
| 16 | municipality in Cook County that either receives water | ||||||||||||||||||||||||||
| 17 | directly from Lake Michigan or buys its water from another | ||||||||||||||||||||||||||
| 18 | municipality and then sells some of its water to another | ||||||||||||||||||||||||||
| 19 | municipality. | ||||||||||||||||||||||||||
| 20 | (b) The Cook County Water Infrastructure Fund is created | ||||||||||||||||||||||||||
| 21 | as a special fund in the State treasury. Subject to | ||||||||||||||||||||||||||
| 22 | appropriation, moneys in the Fund shall be used by the | ||||||||||||||||||||||||||

| 1 | Environmental Protection Agency to make grants to | ||||||
| 2 | municipalities to fund infrastructure improvements to | ||||||
| 3 | facilitate water supplies from Lake Michigan for residents of | ||||||
| 4 | Cook County. | ||||||
| 5 | Notwithstanding any other provision of law, the Cook | ||||||
| 6 | County Water Infrastructure Fund is not subject to sweeps, | ||||||
| 7 | administrative charges or chargebacks, or any other fiscal or | ||||||
| 8 | budgetary maneuver that would in any way transfer any funds | ||||||
| 9 | from the Cook County Water Infrastructure Fund into any other | ||||||
| 10 | fund of the State. | ||||||
| 11 | (c) In making grants from the Cook County Water | ||||||
| 12 | Infrastructure Fund, the Agency must prioritize water | ||||||
| 13 | infrastructure projects in non-supplying municipalities in | ||||||
| 14 | Cook County over water infrastructure projects in supplying | ||||||
| 15 | municipalities in Cook County. | ||||||
| 16 | (d) The Environmental Protection Agency may adopt rules | ||||||
| 17 | under the Illinois Administrative Procedure Act to implement | ||||||
| 18 | this Section.

| 19 | Section 99. Effective date. This Act takes effect upon | ||||||
| 20 | becoming law.
