Bill Title: Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that for a person married in any county in this State, the county clerk shall issue a new marriage certificate when it receives legal documentation indicating one of the parties listed on the certificate has legally changed names. Provides that if a new marriage certificate is issued, the original certificate shall not be subject to inspection or certification except upon order of the circuit court, request of a person named on the marriage certificate, or as provided by rule. Effective immediately.

SYNOPSIS AS INTRODUCED:
750 ILCS 5/221 new

Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that for a person married in any county in this State, the county clerk shall issue a new marriage certificate when it receives legal documentation indicating one of the parties listed on the certificate has legally changed names. Provides that if a new marriage certificate is issued, the original certificate shall not be subject to inspection or certification except upon order of the circuit court, request of a person named on the marriage certificate, or as provided by rule. 1 AN ACT concerning civil law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Marriage and Dissolution of
5Marriage Act is amended by adding Section 221 as follows:
6 (750 ILCS 5/221 new)
7 Sec. 221. Name change on marriage certificate.
8 (a) For a person married in any county in this State, the
9county clerk shall issue a new marriage certificate when it
10receives legal documentation indicating that one of the
11parties listed on the certificate has legally changed names.
12An order for name change issued pursuant to Section 21-101 of
13the Code of Civil Procedure shall be the only legal
14documentation that a county clerk may require. The new
15marriage certificate shall reflect the legal name change and
16shall bear no additional markings.
17 (b) If a new marriage certificate is issued pursuant to
18subsection (a), the original marriage certificate shall not be
19subject to inspection or certification except upon order of
20the circuit court, request of a person named on the marriage
21certificate, or as provided by rule.
22 Section 99. Effective date. This Act takes effect upon
