Bill Title: Amends the Illinois Insurance Code. Provides that an insurer may not refuse to issue vehicle insurance to a person solely because the applicant is a volunteer driver and may not impose a surcharge or otherwise increase the rate for a vehicle policy solely on the basis that the named insured or any member of the insured's household or a person who customarily operates the insured's vehicle is a volunteer driver. Provides that the provision concerning volunteer driver protection shall not prohibit an insurer from taking any actions upon factors other than the volunteer status of the insured driver. Effective immediately.

AMENDMENT TO SENATE BILL 2240
2 AMENDMENT NO. ______. Amend Senate Bill 2240 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Insurance Code is amended by
5adding Section 143.19.2 as follows:
6 (215 ILCS 5/143.19.2 new)
7 Sec. 143.19.2. Volunteer driver protection.
8 (a) For the purpose of this Section, "volunteer driver"
9means a person who transports individuals or goods without
10compensation above reimbursement for expenses. Such volunteer
11driving must be performed for a not-for-profit agency or
12charitable organization, as defined in the General Not for
13Profit Corporation Act of 1986, that allows older individuals
14to transfer their automobiles to the organization in exchange
15for personal transportation services.
16 (b) An insurer may not refuse to issue vehicle insurance to

1a person solely because the applicant is a volunteer driver. An
2insurer may not impose a surcharge or otherwise increase the
3rate for a vehicle policy solely on the basis that the named
4insured or any member of the insured's household or a person
5who customarily operates the insured's vehicle is a volunteer
6driver who volunteer drives 24 hours or less per week. This
7Section shall not prohibit an insurer from taking any actions
8upon factors other than the volunteer status of the insured
9driver.
10 Section 99. Effective date. This Act takes effect upon
11becoming law.".
