| 1 | AN ACT concerning State government.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 5. The Department of Transportation Law of the
| |||||||||||||||||||
| 5 | Civil Administrative Code of Illinois is amended by adding | |||||||||||||||||||
| 6 | Section 615 as follows:
| |||||||||||||||||||
| 7 | (20 ILCS 2705/615 new) | |||||||||||||||||||
| 8 | Sec. 615. Supplemental funding; Illinois Transportation | |||||||||||||||||||
| 9 | Enhancement Program. | |||||||||||||||||||
| 10 | (a) In addition to any other funding that may be provided | |||||||||||||||||||
| 11 | to the Illinois Transportation Enhancement Program from | |||||||||||||||||||
| 12 | federal, State, or other sources, including, but not limited | |||||||||||||||||||
| 13 | to, the Transportation Alternatives Set-Aside of the Surface | |||||||||||||||||||
| 14 | Transportation Block Grant Program, the Department shall set | |||||||||||||||||||
| 15 | aside an amount equal to 2% of the total appropriation received | |||||||||||||||||||
| 16 | by the Department from the Road Fund for the projects in the | |||||||||||||||||||
| 17 | following categories: pedestrian and bicycle facilities; | |||||||||||||||||||
| 18 | streetscape projects; and the conversion of abandoned railroad | |||||||||||||||||||
| 19 | corridors to trails. | |||||||||||||||||||
| 20 | (b) Except as provided in subsection (c), funds set aside | |||||||||||||||||||
| 21 | under subsection (a) shall be administered according to the | |||||||||||||||||||
| 22 | requirements of the current Guidelines Manual published by the | |||||||||||||||||||
| 23 | Department for the Illinois Transportation Enhancement | |||||||||||||||||||
| |||||||
| |||||||
| 1 | Program, including, but not limited to, decision-making by the | ||||||
| 2 | Department and the applicable Metropolitan Planning | ||||||
| 3 | Organization and proportional fund distribution according to | ||||||
| 4 | population size. | ||||||
| 5 | (c) For projects funded under this Section: | ||||||
| 6 | (1) Local matching funding shall be required according | ||||||
| 7 | to a sliding scale based on community size, median income, | ||||||
| 8 | and total property tax base. | ||||||
| 9 | (2) Phase I Studies and Phase I Engineering Reports are | ||||||
| 10 | not required to be completed before application is made. | ||||||
| 11 | (3) At least 25% of funding shall be directed towards | ||||||
| 12 | projects in high-need communities, based on community | ||||||
| 13 | median income and total property tax base. | ||||||
| 14 | (d) The Department shall adopt rules necessary to implement | ||||||
| 15 | this Section.
