Bill Title: Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that "local public entity" includes any not-for-profit corporation authorized by agreement with a local governmental body to operate a museum, zoological park, horticultural park or garden, aquarium, or other cultural institution on land owned by a municipality, county, park district, or forest preserve district. Provides that the changes are declarative of existing law.

AN ACT concerning civil law.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Local Governmental and Governmental
Employees Tort Immunity Act is amended by changing Section
1-206 as follows:
(745 ILCS 10/1-206) (from Ch. 85, par. 1-206)
Sec. 1-206. "Local public entity" includes a county,
township, municipality, municipal corporation, school
district, school board, educational service region, regional
board of school trustees, trustees of schools of townships,
treasurers of schools of townships, community college
district, community college board, forest preserve district,
park district, fire protection district, sanitary district,
museum district, emergency telephone system board, and all
other local governmental bodies. "Local public entity" also
includes library systems and any intergovernmental agency or
similar entity formed pursuant to the Constitution of the State
of Illinois or the Intergovernmental Cooperation Act as well as
any not-for-profit corporation organized for the purpose of
conducting public business, including any not-for-profit
corporation authorized by agreement with a local governmental
body to operate a museum, zoological park, horticultural park

or garden, aquarium, or other cultural institution on land
owned by a municipality, county, park district, or forest
preserve district. It does not include the State or any office,
officer, department, division, bureau, board, commission,
university or similar agency of the State.
The changes made by this amendatory Act of the 94th General
Assembly do not apply to an action or proceeding accruing on or
before its effective date. The changes made by this amendatory
Act of the 99th General Assembly are declarative of existing
law.
