Bill Title: Amends the Illinois Procurement Code. Provides that when a State contract for data processing, hosting, or related services is to be awarded to the lowest responsible bidder, an otherwise qualified bidder who will fulfill the contract by employing exclusively Illinois residents may be given a preference over other bidders unable or unwilling to do so, so long as the total contract price in the bid of the bidder who will employ exclusively Illinois residents is no more than 15% greater than the total contract price in the bid of the lowest responsible bidder who is unable or unwilling to do so.

AN ACT concerning finance.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Procurement Code is amended by
adding Section 45-85 as follows:

Sec. 45-85. Electronic data processing preference. When a
State contract for data processing, hosting, or related
services is to be awarded to the lowest responsible bidder, an
otherwise qualified bidder who will fulfill the contract by
employing exclusively Illinois residents may be given a
preference over other bidders unable or unwilling to do so,
provided that the total contract price in the bid of the bidder
who will employ exclusively Illinois residents is no more than
15% greater than the total contract price in the bid of the
lowest responsible bidder who is unable or unwilling to do so.
For the purposes of this Section, "contract for data
processing, hosting, or related services" means a contract for
application hosting, ASP provider services, automated data
processing services, computer data storage services, computer
input preparation services, data capture imaging services,
data entry services, data processing computer services, data
processing services (except payroll services and financial

transaction processing services), disk and diskette conversion
services, electronic data processing services, microfiche
recording and imaging services, microfilm recording and
imaging services, or optical scanning services.
