Bill Title: Amends the Illinois Procurement Code. Provides that when a State contract for data processing, hosting, or related services is to be awarded to the lowest responsible bidder, an otherwise qualified bidder who will fulfill the contract by employing exclusively Illinois residents may be given a preference over other bidders unable or unwilling to do so, so long as the total contract price in the bid of the bidder who will employ exclusively Illinois residents is no more than 15% greater than the total contract price in the bid of the lowest responsible bidder who is unable or unwilling to do so.

| 1 | AN ACT concerning finance.

| 2 | Be it enacted by the People of the State of Illinois,

| 3 | represented in the General Assembly:

| 4 | Section 5. The Illinois Procurement Code is amended by | ||||||||||||||||||||||||
| 5 | adding Section 45-85 as follows:

| 6 | (30 ILCS 500/45-85 new) | ||||||||||||||||||||||||
| 7 | Sec. 45-85. Electronic data processing preference. When a | ||||||||||||||||||||||||
| 8 | State contract for data processing, hosting, or related | ||||||||||||||||||||||||
| 9 | services is to be awarded to the lowest responsible bidder, an | ||||||||||||||||||||||||
| 10 | otherwise qualified bidder who will fulfill the contract by | ||||||||||||||||||||||||
| 11 | employing exclusively Illinois residents may be given a | ||||||||||||||||||||||||
| 12 | preference over other bidders unable or unwilling to do so, | ||||||||||||||||||||||||
| 13 | provided that the total contract price in the bid of the bidder | ||||||||||||||||||||||||
| 14 | who will employ exclusively Illinois residents is no more than | ||||||||||||||||||||||||
| 15 | 15% greater than the total contract price in the bid of the | ||||||||||||||||||||||||

| 20 | processing services, computer data storage services, computer | ||||||||||||||||||||||||
| 21 | input preparation services, data capture imaging services, | ||||||||||||||||||||||||
| 22 | data entry services, data processing computer services, data | ||||||||||||||||||||||||
| 23 | processing services (except payroll services and financial | ||||||||||||||||||||||||

| 1 | transaction processing services), disk and diskette conversion | ||||||
| 2 | services, electronic data processing services, microfiche | ||||||
| 3 | recording and imaging services, microfilm recording and | ||||||
| 4 | imaging services, or optical scanning services.
