Bill Title: Amends the Counties Code. Provides that county contracts may be awarded as a sole source procurement unless an interested party submits a written request for a public hearing. Provides that contracts for professional or artistic services cannot be amended through use of sole source procurements if the result would increase in the amount paid under the contract of more than 5% of the initial award, or would extend the contract term beyond the time reasonably needed for a competitive procurement, not to exceed 2 months. Further provides for notice requirements and requires the county board to file a yearly report with the General Assembly concerning procurement contracts entered into. Effective immediately.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Counties Code is amended by adding Section | ||||||
| 5 | 5-1022.5 as follows:
| ||||||
| 6 | (55 ILCS 5/5-1022.5 new) | ||||||
| 7 | Sec. 5-1022.5. Sole source procurement. Purchases of and | ||||||
| 8 | contracts for goods and services which by their nature are not | ||||||
| 9 | adapted to award by competitive bidding shall not be subject to | ||||||
| 10 | the competitive bidding requirements of this Code, including, | ||||||
| 11 | but not limited to: contracts for the services of individuals | ||||||
| 12 | possessing a high degree of professional skill where the | ||||||
| 13 | ability or fitness of the individual plays an important part; | ||||||
| 14 | purchases of and contracts for supplies, materials, parts, or | ||||||
| 15 | equipment which are available only from a single source; | ||||||
| 16 | purchases of or contracts for printing of finance committee | ||||||
| 17 | pamphlets, comptroller's estimates, and departmental reports; | ||||||
| 18 | contracts for the printing or engraving of bonds, tax warrants, | ||||||
| 19 | and other evidences of indebtedness; purchases of and contracts | ||||||
| 20 | for utility services such as water, light, heat, telephone, or | ||||||
| 21 | internet; purchases of and contracts for the purchase of | ||||||
| 22 | magazines, books, periodicals, and similar articles of an | ||||||
| 23 | educational or instructional nature; the binding of such | ||||||

| 1 | magazine, books, periodicals, pamphlets, reports, and similar | ||||||
| 2 | articles; and purchases of and contracts for maintenance of | ||||||
| 3 | computer hardware and software.

| 4 | Section 99. Effective date. This Act takes effect upon | ||||||
| 5 | becoming law.
