AMENDMENT TO SENATE BILL 1643
AMENDMENT NO. ______. Amend Senate Bill 1643, AS AMENDED,
with reference to page and line numbers of Senate Amendment No.
1, on page 17, by inserting immediately after line 12 the
following:
"(M) An offense involving consensual sexual conduct in
violation of subsection (c) of Section 11-1.50 of the Criminal
Code of 2012 is not a sex offense for the purposes of this
Section if the victim was at least 13 years of age and the
offender was not more than 4 years older than the victim, and
the court makes a factual finding that:
(1) the sexual conduct was not the result of compulsion
or undue influence; and
(2) the offender is not a risk of re-offending based
on:
(A) a risk assessment performed by an evaluator
approved by the Sex Offender Management Board;
(B) the sex offender history of the offender;

(C) information related to the registrant's
mental, physical, educational, and social history;
(D) victim impact statements; and
(E) any other factors deemed relevant by the
court."; and
on page 34, line 25, by inserting "or aggravated criminal
sexual abuse under subsection (d) of Section 11-1.60" after
"Section 11-1.50"; and
on page 37, line 1, by inserting "or aggravated criminal sexual
abuse under subsection (d) of Section 11-1.60" after "Section
11-1.50"; and
on page 37, line 5, by inserting "or aggravated criminal sexual
abuse under subsection (d) of Section 11-1.60" after "11-1.50".
