1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Highway Code is amended by changing
5Sections 4-220 and 4-405 as follows:
6 (605 ILCS 5/4-220)
7 Sec. 4-220. Bicycle and pedestrian ways.
8 (a) Bicycle and pedestrian ways shall be given full
9consideration in the planning and development of
10transportation facilities, including the incorporation of such
11ways into State plans and programs.
12 (b) In or within one mile of an urban area, bicycle and
13pedestrian ways shall be established in conjunction with the
14construction, reconstruction, or other change of any State
15transportation facility except:
16 (1) in pavement resurfacing projects that do not widen
17 the existing traveled way or do not provide stabilized
18 shoulders; or
19 (2) where approved by the Secretary of Transportation
20 based upon documented safety issues, excessive cost or
21 absence of need.
22 (c) Bicycle and pedestrian ways may be included in pavement
23resurfacing projects when local support is evident or bicycling

1and walking accommodations can be added within the overall
2scope of the original roadwork.
3 (d) The Department shall establish design and construction
4standards for bicycle and pedestrian ways. Beginning July 1,
52007, this Section shall apply to planning and training
6purposes only. Beginning July 1, 2008, this Section shall apply
7to construction projects.
8 (e) The Department shall comply with the Department's IDOT
9ADA transition plan while executing any of the projects within
10this Section.

13 Sec. 4-405.
14 The Department shall maintain all highways in the State
15highway system either with its own forces or pursuant to an
16agreement or contract entered into pursuant to this Code.
17 In the course of its other maintenance work, the Department
18shall paint and maintain a line not less than 2 1/2 inches in
19width on the edges of uncurbed roadways of all State highways
20having an Illinois or U.S. route traffic marking and which
21carry an average daily traffic of more than 1000 vehicles. The
22Department may paint and maintain such lines on such other
23State highways as it deems desirable.
24 In the course of its maintenance work, including the
25resurfacing or the reconstructing of State highways, the
