Bill Title: Amends the Illinois Notary Public Act. Provides that any person who performs a notarial act concerning election nominating papers, petitions of objections to nominating papers, or certificates of withdrawal of candidacy, and is not otherwise authorized to perform notarial acts, shall, in addition to any penalties which may be imposed under the Act, also be in violation of the Election Code. Amends the Election Code. Provides that any person who performs unauthorized notarial acts concerning election nominating papers, petitions of objections to nominating papers, or certificates of withdrawal of candidacy in violation of the Illinois Notary Public Act, is also in violation of the Code, and shall be subject to a specified penalty.

Amends the Illinois Notary Public Act. Provides that any person who performs a notarial act concerning election nominating papers, petitions of objections to nominating papers, or certificates of withdrawal of candidacy, and is not otherwise authorized to perform notarial acts, shall, in addition to any penalties which may be imposed under the Act, also be in violation of the Election Code. Amends the Election Code. Provides that any person who performs unauthorized notarial acts concerning election nominating papers, petitions of objections to nominating papers, or certificates of withdrawal of candidacy in violation of the Illinois Notary Public Act, is also in violation of the Code, and shall be subject to a specified penalty.

1 AN ACT concerning government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Notary Public Act is amended by
5adding Section 7-110 as follows:
6 (5 ILCS 312/7-110 new)
7 Sec. 7-110. Unauthorized notarization of nominating
8papers. Any person who performs a notarial act concerning
9election nominating papers, petitions of objections to
10nominating papers, or certificates of withdrawal of candidacy,
11and is not otherwise authorized to perform notarial acts under
12this Act, shall, in addition to any penalties which may be
13imposed under this Act, also be in violation of the Election
14Code.
15 Section 10. The Election Code is amended by adding Section
1629-12.5 as follows:

18 Sec. 29-12.5. Unauthorized notarization of nominating
19papers. Any person who performs unauthorized notarial acts
20concerning election nominating papers, petitions of objections
21to nominating papers, or certificates of withdrawal of

1candidacy in violation of Section 7-110 of the Illinois Notary
2Public Act, is also in violation of this Code, and shall, in
3addition to any other penalty which may be provided by law, be
4subject to the penalty provided under Section 29-12.
