| 1 | AMENDMENT TO SENATE BILL 963
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 963 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
| 5 | changing Section 12-401 and by adding Section 1-155.7 as | ||||||
| 6 | follows:

| 7 | (625 ILCS 5/1-155.7 new) | ||||||
| 8 | Sec. 1-155.7. Paratransit vehicle. A vehicle used to | ||||||
| 9 | provide specialized transportation services to an individual | ||||||
| 10 | with disabilities who is unable to use fixed route | ||||||
| 11 | transportation systems and who is eligible for specialized | ||||||
| 12 | transportation services for some or all trips under the | ||||||
| 13 | Americans with Disabilities Act of 1990 and its implementing | ||||||
| 14 | regulations.

| 1 | Sec. 12-401. Restriction as to tire equipment. No metal | ||||||
| 2 | tired vehicle,
including tractors, motor vehicles of the second | ||||||
| 3 | division, traction engines
and other similar vehicles, shall be | ||||||
| 4 | operated over any improved highway
of this State, if such | ||||||
| 5 | vehicle has on the periphery of any of the road wheels
any | ||||||
| 6 | block, stud, flange, cleat, ridge, lug or any projection of | ||||||
| 7 | metal
or wood which projects radially beyond the tread or | ||||||
| 8 | traffic surface
of the tire. This prohibition does not apply
to | ||||||
| 9 | pneumatic tires with metal studs used on vehicles operated by | ||||||
| 10 | rural
letter carriers who are employed or enjoy a contract with | ||||||
| 11 | the United
States Postal Service for the purpose of delivering | ||||||
| 12 | mail if such vehicle
is actually used for such purpose during | ||||||
| 13 | operations between November
15 of any year and April 1 of the | ||||||
| 14 | following year, or to motor vehicles
displaying a disability or | ||||||
| 15 | disabled veteran license plate whose
owner resides in an | ||||||
| 16 | unincorporated area located upon a county or township
highway | ||||||
| 17 | or road and possesses a valid driver's license and operates
the | ||||||
| 18 | vehicle with such tires only during the period heretofore | ||||||
| 19 | described, to paratransit vehicles operated to provide | ||||||
| 20 | transportation for the elderly or disabled residents between | ||||||
| 21 | November 15 of any year and April 1 of the following year,
or | ||||||
| 22 | to tracked type motor vehicles when that part of the vehicle | ||||||
| 23 | coming in
contact with the road surface does not contain any | ||||||
| 24 | projections of any kind
likely to injure the surface of the | ||||||
| 25 | road; however, tractors, traction engines,
and similar | ||||||
| 26 | vehicles may be operated which have upon their road wheels
| ||||||

| 1 | V-shaped, diagonal or other cleats arranged in such a manner as | ||||||
| 2 | to be
continuously in contact with the road surface, provided | ||||||
| 3 | that the gross weight
upon such wheels per inch of width of | ||||||
| 4 | such cleats in contact with the road
surface, when measured in | ||||||
| 5 | the direction of the axle of the vehicle, does not
exceed 800 | ||||||
| 6 | pounds.
| ||||||
| 7 | All motor vehicles and all other vehicles in tow thereof, | ||||||
| 8 | or thereunto
attached, operating upon any roadway, shall have | ||||||
| 9 | tires of rubber or some
material of equal resiliency. Solid | ||||||
| 10 | tires shall be considered defective and
shall not be permitted | ||||||
| 11 | to be used if the rubber or other material has been
worn or | ||||||
| 12 | otherwise reduced to a thickness of less than three-fourths of | ||||||
| 13 | an
undue vibration when the vehicle is in motion or to cause | ||||||
| 14 | undue
concentration of the wheel load on the surface of the | ||||||
| 15 | road. The
requirements of this Section do not apply to | ||||||
| 16 | agricultural tractors or
traction engines or to agricultural | ||||||
| 17 | machinery, including wagons being
used for agricultural | ||||||
| 18 | purposes in tow thereof, or to road rollers or road
building | ||||||
| 19 | machinery operated at a speed not in excess of 10 miles per
| ||||||
| 20 | hour. All motor vehicles of the second division, operating upon | ||||||
| 21 | any
roadway shall have pneumatic tires, unless exempted herein.
| ||||||
| 22 | Nothing in this Section shall be deemed to prohibit the use | ||||||
| 23 | of tire
chains of reasonable proportion upon any vehicle when | ||||||
| 24 | required for
safety because of snow, ice or other conditions | ||||||
| 25 | tending to cause a vehicle
to skid.
