| 1 | AMENDMENT TO SENATE BILL 550
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 550 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Mid-America Intermodal Authority Port | ||||||
| 5 | District Act is amended by changing Sections 100 and 125 as | ||||||
| 6 | follows:

| 8 | Sec. 100.
Mid-America Intermodal Authority Port District | ||||||
| 9 | Board;
compensation. The
governing and administrative body of | ||||||
| 10 | the district shall
be a board consisting of 7 members, to be | ||||||
| 11 | known as the
Mid-America Intermodal Authority
Port District | ||||||
| 12 | Board. Members of the Board shall be residents of a
county | ||||||
| 13 | whose territory, in whole or in part, is embraced by the | ||||||
| 14 | district
and persons of recognized business ability. The | ||||||
| 15 | members of the Board
shall receive compensation for their | ||||||
| 16 | services,
set by the Board at an amount not to exceed $20,000 | ||||||
| |||||||
| |||||||
| 1 | annually, except
the chairperson may receive an additional | ||||||
| 2 | $5,000 annually, if approved by
the Board. All compensation | ||||||
| 3 | shall be paid directly from the
district's
operating funds. The | ||||||
| 4 | members shall receive no other compensation, other than as | ||||||
| 5 | provided for in this Section whatever,
whether in the form of | ||||||
| 6 | salary, per diem allowance, or otherwise, for or in
connection
| ||||||
| 7 | with their service as members. Each member shall be reimbursed
| ||||||
| 8 | for actual expenses incurred by him or her in the performance | ||||||
| 9 | of the member's
duties.
All reimbursements shall be paid | ||||||
| 10 | directly from the district's operating funds. Any person who is | ||||||
| 11 | appointed to the office of secretary or treasurer
of the Board | ||||||
| 12 | may receive compensation for services as an officer,
as | ||||||
| 13 | determined by the Board, provided that the person is not a | ||||||
| 14 | member of the
Board. No member of the Board or employee of the | ||||||
| 15 | district
shall have any private
financial interest, profit, or | ||||||
| 16 | benefit in any contract, work, or business
of the district or | ||||||
| 17 | in the sale or lease of any property to or from the
district.

| 20 | Sec. 125. Secretary and treasurer; oath and bond. The Board | ||||||
| 21 | shall appoint
a secretary
and a treasurer who need
not
be | ||||||
| 22 | members of the Board to hold office during the pleasure of the | ||||||
| 23 | Board. The
Board shall fix their duties and compensation. | ||||||
| 24 | Before entering upon the duties
of
their respective offices, | ||||||
| 25 | they shall take and subscribe the constitutional
oath of office | ||||||
| |||||||
| |||||||
| 1 | and the treasurer shall execute a bond with corporate
sureties | ||||||
| 2 | to be approved by the Board. The bond shall be payable to the
| ||||||
| 3 | district in whatever penal sum may be directed by the Board | ||||||
| 4 | conditioned
upon the faithful performance of the duties to the | ||||||
| 5 | office and the payment
of all money received by him or her | ||||||
| 6 | according to law and the orders of the
Board.
The Board may, at | ||||||
| 7 | any time, require a new bond from the treasurer in any
penal | ||||||
| 8 | sum that may be determined by the Board. The obligation of the
| ||||||
| 9 | sureties shall not extend to any loss sustained by the | ||||||
| 10 | insolvency, failure,
or closing of any savings and loan | ||||||
| 11 | association or national or State
bank wherein the treasurer has
| ||||||
| 12 | deposited funds if the bank or savings and loan association has | ||||||
| 13 | been
approved by the Board as a depositary
for those funds. The | ||||||
| 14 | oaths of office and the treasurer's bond shall be
filed in the | ||||||
| 15 | principal office of the district.

| 17 | Section 99. Effective date. This Act takes effect upon | ||||||
| 18 | becoming law.".
