| 1 | AN ACT concerning courts.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 5. The Juvenile Court Act of 1987 is amended by | |||||||||||||||||||
| 5 | changing Section 5-125 as follows:
| |||||||||||||||||||
| 6 | (705 ILCS 405/5-125)
| |||||||||||||||||||
| 7 | Sec. 5-125. Concurrent jurisdiction. Any minor alleged to | |||||||||||||||||||
| 8 | have violated a traffic, boating, or fish and
and game law,
or | |||||||||||||||||||
| 9 | a municipal or county ordinance, may be prosecuted for the | |||||||||||||||||||
| 10 | violation and if
found
guilty punished under any statute or | |||||||||||||||||||
| 11 | ordinance relating to the violation,
without reference to the | |||||||||||||||||||
| 12 | procedures set out in this Article, except that: | |||||||||||||||||||
| 13 | (1) any
detention, must be in compliance with this | |||||||||||||||||||
| 14 | Article; and | |||||||||||||||||||
| 15 | (2) the confidentiality of records provisions in Part 9
| |||||||||||||||||||
| 16 | of this Article shall apply to any law enforcement and
| |||||||||||||||||||
| 17 | court records relating to prosecution of a minor under 18
| |||||||||||||||||||
| 18 | years of age for a municipal or county ordinance violation | |||||||||||||||||||
| 19 | or a violation of subsection (a) of Section 4 of the | |||||||||||||||||||
| 20 | Cannabis Control Act or subsection (c) of Section 3.5 of | |||||||||||||||||||
| 21 | the Drug Paraphernalia Control Act;
except that these | |||||||||||||||||||
| 22 | confidentiality provisions shall not
apply to or affect any | |||||||||||||||||||
| 23 | proceeding to adjudicate the
violation.

| 1 | For the purpose of this Section, "traffic violation" shall | ||||||
| 2 | include a
violation of Section 9-3 of the Criminal Code of 1961 | ||||||
| 3 | or the Criminal Code of 2012 relating to the offense
of
| ||||||
| 4 | reckless homicide, Section 11-501 of the Illinois Vehicle Code, | ||||||
| 5 | or any similar
county or municipal ordinance.
