1 | AN ACT concerning education.

2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The School Code is amended by changing Section | ||||||
5 | 24A-7 as follows:
| ||||||

7 | Sec. 24A-7. Rules. The State Board of Education is | ||||||
8 | authorized to adopt such rules as
are deemed necessary to | ||||||
9 | implement and accomplish the purposes and
provisions of this | ||||||
10 | Article, including, but not limited to, rules (i) relating to | ||||||
11 | the methods for measuring student growth (including, but not | ||||||
12 | limited to, limitations on the age of useable data; the amount | ||||||
13 | of data needed to reliably and validly measure growth for the | ||||||
14 | purpose of teacher and principal evaluations; and whether and | ||||||
15 | at what time annual State assessments may be used as one of | ||||||
16 | multiple measures of student growth), (ii) defining the term | ||||||
17 | "significant factor" for purposes of including consideration | ||||||
18 | of student growth in performance ratings, (iii) controlling for | ||||||
19 | such factors as student characteristics (including, but not | ||||||
20 | limited to, students receiving special education and English | ||||||
21 | Language Learner services), student attendance, and student | ||||||
22 | mobility so as to best measure the impact that a teacher, | ||||||
23 | principal, school and school district has on students' academic |

1 | achievement, (iv) establishing minimum requirements for | ||||||
2 | district teacher and principal evaluation instruments and | ||||||
3 | procedures, and (v) establishing a model evaluation plan for | ||||||
4 | use by school districts in which student growth shall comprise | ||||||
5 | 50% of the performance rating. Notwithstanding any provision in | ||||||
6 | this Section, such rules shall not preclude a school district | ||||||
7 | having 500,000 or more inhabitants from using an annual State | ||||||
8 | assessment as the sole measure of student growth for purposes | ||||||
9 | of teacher or principal evaluations. | ||||||
10 | The rules shall be developed through a process involving | ||||||
11 | collaboration with a Performance Evaluation Advisory Council, | ||||||
12 | which shall be convened and staffed by the State Board of | ||||||
13 | Education. Members of the Council shall be selected by the | ||||||
14 | State Superintendent and include, without limitation, | ||||||
15 | representatives of teacher unions and school district | ||||||
16 | management, persons with expertise in performance evaluation | ||||||
17 | processes and systems, as well as other stakeholders. The | ||||||
18 | Performance Evaluation Advisory Council shall meet at least | ||||||
19 | quarterly following the effective date of this amendatory Act | ||||||
20 | of the 96th General Assembly until June 30, 2021 2017 . | ||||||
21 | Prior to the applicable implementation date, these rules | ||||||
22 | shall not apply to teachers assigned to schools identified in | ||||||
23 | an agreement entered into between the board of a school | ||||||
24 | district operating under Article 34 of this Code and the | ||||||
25 | exclusive representative of the district's teachers in | ||||||
26 | accordance with Section 34-85c of this Code. |
