1 AN ACT concerning children.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Children's Privacy Protection and Parental
5Empowerment Act is amended by changing Section 15 as follows:
6 (325 ILCS 17/15)
7 (Section scheduled to be repealed on January 1, 2015)
8 Sec. 15. Information brokers.
9 (a) For the the purpose of this Act, the consent of a
10parent to the sale or purchase of information concerning a
11child is presumed unless the parent withdraws consent under
12this Section.
13 A person who brokers or facilitates the sale of personal
14information concerning children must, upon written request
15from a parent that specifically identifies the child, provide
16to the parent within 20 days of the written request procedures
17that the parent must follow in order to withdraw consent to use
18personal information relating to that child. The person who
19brokers or facilitates the sale of personal information must
20discontinue disclosing a child's personal information within
2120 days after the parent has completed the procedures to
22withdraw consent to use personal information relating to that
23child.

1 (b) This Section does not apply to any of the following:
2 (1) Any federal, state, or local government agency or
3 any law enforcement agency.
4 (2) The National Center for Missing and Exploited
5 Children.
6 (3) Any educational institution, consortium,
7 organization, or professional association, including but
8 not limited to, public community colleges, public
9 universities, post-secondary educational institutions as
10 defined in the Private College Act, and private business
11 and vocational schools as defined in the Private Business
12 and Vocational Schools Act of 2012.
13 (4) Any not-for-profit entity that is exempt from the
14 payment of federal taxes under Section 501(c)(3) of the
15 Internal Revenue Code of 1986.
