Bill Title: Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Authorizes the Department of Commerce and Economic Opportunity, subject to appropriation, to create financial incentive and grant programs to encourage private companies to share their new energy technologies with public institutions of higher education, public utilities, State agencies, and federal agencies.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Department of Commerce and Economic | ||||||
| 5 | Opportunity Law of the
Civil Administrative Code of Illinois is | ||||||
| 6 | amended by adding Section 605-1005 as follows:

| 7 | (20 ILCS 605/605-1005 new) | ||||||
| 8 | Sec. 605-1005. Technology transfer incentives. The | ||||||
| 9 | Department may, subject to appropriation, create financial | ||||||
| 10 | incentive and grant programs to encourage private companies to | ||||||
| 11 | share their new energy technologies with public institutions of | ||||||
| 12 | higher education, public utilities, electric cooperatives, | ||||||
| 13 | State agencies, and federal agencies. For the purposes of this | ||||||
| 14 | Section, "public institutions of higher education" has the same | ||||||
| 15 | meaning as under Section 1 of the Board of Higher Education | ||||||
| 16 | Act; "public utility" has the same meaning as under Section | ||||||
| 17 | 3-105 of the Public Utilities Act; "electric cooperative" has | ||||||
| 18 | the same meaning as under Section 3-119 of the Public Utilities | ||||||
| 19 | Act; "State agency" has the same meaning as under Section 1-10 | ||||||
| 20 | of the Illinois Administrative Procedure Act; and "federal | ||||||
| 21 | agency" has the same meaning ascribed to the term "agency" | ||||||
| 22 | under Section 551 of the federal Administrative Procedure Act.
