Bill Title: Amends the Illinois Municipal Code. Provides that public funds shall not be expended by a municipality for expenses connected with a convention or gathering of municipal personnel. Provides that a State agency may not expend public funds for expenses connected with the renting or procurement of booths, hospitality suites, or other physical spaces at a convention or gathering of municipal personnel. Provides that a "convention or gathering of municipal personnel" means a gathering of employees or contractors from 2 or more separately domiciled or geographically separated municipalities in a gathering that is sponsored or co-sponsored by a league or association that includes 2 or more municipalities. Provides that the restrictions do not apply to public funds expended at a convention or gathering of public safety personnel, at a convention or gathering relating to economic development and tourism promotion, pursuant to a contract entered into before the effective date of the amendatory Act, or funds appropriated and expended by a municipality if specified procedures are followed. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Illinois Municipal Code is amended by adding | ||||||||||||||||||||||||
5 | Section 8-1-2.7 as follows:

7 | Sec. 8-1-2.7. Conventions and gathering of municipal | ||||||||||||||||||||||||
8 | personnel. | ||||||||||||||||||||||||
9 | (a) As used in this Section: | ||||||||||||||||||||||||
10 | "Convention or gathering of municipal personnel" means a | ||||||||||||||||||||||||
11 | gathering of employees or contractors from 2 or more separately | ||||||||||||||||||||||||
12 | domiciled or geographically separated municipalities in a | ||||||||||||||||||||||||
13 | gathering that is sponsored or co-sponsored by a league or | ||||||||||||||||||||||||
14 | association that includes 2 or more municipalities. | ||||||||||||||||||||||||
15 | "Public safety personnel" has the meaning given to that | ||||||||||||||||||||||||
16 | term in subsection (m-5) of Section 1 of the Solicitation for | ||||||||||||||||||||||||
17 | Charity Act. | ||||||||||||||||||||||||
18 | "State agency" means a department of the executive branch | ||||||||||||||||||||||||
19 | of State government listed in Section 5-15 of the Departments | ||||||||||||||||||||||||
20 | of State Government Law of the Civil Administrative Code of | ||||||||||||||||||||||||
21 | Illinois. | ||||||||||||||||||||||||
22 | (b) Public funds may not be expended by a municipality for | ||||||||||||||||||||||||
23 | expenses connected with a convention or gathering of municipal |

2 | (c) A State agency may not expend public funds for expenses | ||||||
3 | connected with the renting or procurement of booths, | ||||||
4 | hospitality suites, or other physical spaces at a convention or | ||||||
5 | gathering of municipal personnel. | ||||||
6 | (d) This Section does not apply to public funds expended: | ||||||
7 | (1) at a convention or gathering of public safety personnel; | ||||||
8 | (2) at a convention or gathering of municipal personnel | ||||||
9 | relating to economic development and tourism promotion; or (3) | ||||||
10 | pursuant to a contract entered into before the effective date | ||||||
11 | of this amendatory Act of the 100th General Assembly. | ||||||
12 | (e) This Section does not apply to public funds | ||||||
13 | appropriated and expended by a municipality if: | ||||||
14 | (1) the appropriation is contained within a line item | ||||||
15 | dedicated solely to convention expenses that includes the | ||||||
16 | name and job title of each employee or contractor who may | ||||||
17 | be reimbursed; | ||||||
18 | (2) notice of the appropriation is posted on the | ||||||
19 | municipality's website not less than 30 days prior to the | ||||||
20 | meeting in which the appropriation will come up for a vote, | ||||||
21 | and the notice must include a statement that the proposed | ||||||
22 | appropriation will use taxpayer funds to allow one or more | ||||||
23 | of the municipality's employees or contractors to travel to | ||||||
24 | a convention; and | ||||||
25 | (3) the appropriation is approved by a three-fifths | ||||||
26 | majority vote of the governing body of the municipality.

1 | Section 99. Effective date. This Act takes effect upon | ||||||
2 | becoming law.
