AN ACT concerning land.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Adjutant General, on behalf of the State of
Illinois and the Department of Military Affairs, is authorized
to convey by Quitclaim Deed all right, title, and interest of
the State of Illinois and the Department of Military Affairs in
and to the real estate described in Section 10 to the
Beardstown Park District, subject to the conditions and
restriction described in Section 15.
Section 10. The Adjutant General is authorized to convey
the following described real property:
Parcel No. 1
Part of the Southeast Quarter (SE1/4), Section Fourteen
(14), Township Eighteen (18) North, Range Twelve (12) West of
the Third Principal Meridian, Cass County, Illinois, described
as follows:
Beginning at the center Southeast Quarter (SE1/4), Section
Fourteen (14), Township Eighteen (18) North, Range Twelve
(12) West of the Third Principal Meridian; thence South
zero degrees, six minutes, thirty-two seconds (0° 6' 32")
East, three hundred eighty-one and seventy-eight
hundredths (381.78) feet along the North and South
Centerline of the Southeast Quarter (SE1/4), said Section
Fourteen (14); thence North sixty-four degrees, fifty-four
minutes, twenty-six seconds (64° 54' 26") West, two hundred
eight-four and fifty-nine hundredths (284.59) feet; thence
South fifteen degrees, thirty-five minutes, fifty-six
seconds (15° 35' 56") West, two hundred twenty-three and
sixty-hundredths (223.60) feet to a point on the North
Right-of-Way Line of the Original S.B.I. Route No. 3,
formerly U.S. Route No. 67; then North sixty degrees,
twelve minutes, four seconds (60° 12' 4") West, three
hundred nine and twenty-hundredths (309.20) feet along
said Right-of-Way Line; thence North twenty-five degrees,
fifty-four minutes, fifty-six seconds (25° 54' 56") East,
six hundred thirty-one (631.0) feet; thence North
eighty-six degrees, twenty-three minutes, fifteen seconds
(86° 23' 15") East, three hundred ten and thirteen
hundredths (310.13) feet to a point on the North and South
Center-line of the Southeast Quarter (SE1/4), said Section
Fourteen (14); thence South zero degrees, six minutes,
thirty-two seconds (0° 6' 32") East, two sixty-four and
fifty hundredths (264.50) feet along said Centerline to the
Point of Beginning, containing six and forty-three (6.43)
acres, more or less.
Parcel No. 2
Part of the Southeast Quarter (SE1/4), Section Fourteen
(14), Township Eighteen (18) North, Range Twelve (12) West of
the Third Principal Meridian, Cass County, Illinois, described
as follow:
Beginning at the center Southeast Quarter (SE1/4), Section
Fourteen (14), Township Eighteen (18) North, Range Twelve
(12) West of the Third Principal Meridian; thence North
eighty-nine degrees, fifty-three minutes, twenty-eight
seconds (89° 53' 28") East, three hundred fifty (350) feet
along the North Boundary of the Southeast Quarter (SE1/4)
of the Southeast Quarter (SE1/4) of said Section Fourteen
(14); thence South twelve degrees, eighteen minutes,
thirty-two seconds (12° 18' 32") West, four hundred
sixty-eight and five-tenths (468.5) feet; thence North
seventy-three degrees, twelve minutes, twelve seconds (73°
12' 12") West, two hundred sixty and fifty-hundredths
(260.50) feet; to a point on the North and South Centerline
of the Southeast Quarter (SE1/4) of said Section Fourteen
(14); thence North zero degrees, six minutes, thirty-two
seconds (0° 6' 32") West, three hundred eighty-one and
seventy-eight (381.78) feet along said North and South
Centerline to the Point of Beginning, containing two and
ninety-three (2.93) acres, more or less.
Section 15. The Adjutant General shall not convey the real
property described in Section 10 to the Beardstown Park
District until the Adjutant General determines that the
property is no longer required for military purposes.
Conveyance of the above real property will be in an "as is"
condition, and the Beardstown Park District will pay all
required costs and expenses for the conveyance, as determined
by the Adjutant General. The Quitclaim Deed shall state on its
face and be subject to the condition that if the property is no
longer used for public purposes, then title shall revert
without further action to the State of Illinois.
Section 20. The Adjutant General shall obtain a certified
copy of this Act from the Secretary of State within 60 days
after its effective date and, upon the conveyance of the real
estate described in Section 10 being made, shall cause the
certified copy of this Act to be recorded in the office of the
Recorder of Cass County.
Section 99. Effective date. This Act takes effect upon
becoming law.
