Bill Title: Amends the Lead Poisoning Prevention Act. Provides that the Department of Public Health may record lead mitigation notices for properties subject to such notices at the recorder of deeds for the county or counties in which the property is located. Provides that upon successful mitigation, the Department shall record a notice of successful mitigation at the recorder of deeds for the county or counties in which the property is located. Effective immediately.

| 1 | AN ACT concerning health.

| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 5. The Lead Poisoning Prevention Act is amended by | |||||||||||||||||||
| 5 | adding Section 9.5 as follows:
| |||||||||||||||||||
| 6 | (410 ILCS 45/9.5 new) | |||||||||||||||||||
| 7 | Sec. 9.5. Recording of mitigation notices. For any property | |||||||||||||||||||
| 8 | whose owner has been issued a mitigation notice as provided for | |||||||||||||||||||
| 9 | under Section 9 of this Act, the Department may record the | |||||||||||||||||||
| 10 | notice at the recorder of deeds for the county or counties in | |||||||||||||||||||
| 11 | which the property is located. Upon successful mitigation of | |||||||||||||||||||
| 12 | the lead hazard, as provided in Section 9 of this Act, the | |||||||||||||||||||
| 13 | Department shall record a notice of successful mitigation at | |||||||||||||||||||
| 14 | the recorder of deeds for the county or counties in which the | |||||||||||||||||||
| 15 | property is located.
