Bill Title: Amends the Department of Human Services Act. Provides that subject to appropriation, there is created the HIV/AIDS Nutrition and Outcomes Advisory Commission to advise the Department of Human Services on how best to incorporate nutrition as an HIV/AIDS disease management strategy into State health policy to avoid Medicaid hospitalizations, and how to measure health care outcomes that will likely be required by new federal legislation. Provides that the Commission shall consist of 9 members including 5 members appointed by the Governor. Contains provisions on terms of membership; Commission meetings; and reporting requirements. Effective immediately.

1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Department of Human Services Act is amended
5 by adding Section 10-31 as follows:
6 (20 ILCS 1305/10-31 new)
7 Sec. 10-31. Chronic Disease Nutrition and Outcomes
8 Advisory Commission.
9 (a) Subject to appropriation, the Chronic Disease
10 Nutrition and Outcomes Advisory Commission is created to advise
11 the Department on how best to incorporate nutrition as a
12 chronic disease management strategy into State health policy to
13 avoid Medicaid hospitalizations, and how to measure health care
14 outcomes that will likely be required by new federal
15 legislation.
16 (b) The Commission shall consist of all of the following
17 members:
18 (1) One member of the Senate appointed by the President
19 of the Senate and one member of the Senate appointed by the
20 Minority Leader of the Senate.
21 (2) One member of the House of Representatives
22 appointed by the Speaker of the House of Representatives
23 and one member of the House of Representatives appointed by

1 the Minority Leader of the House of Representatives.
2 (3) Five members appointed by the Governor as follows:
3 (A) One representative of a not-for-profit social
4 service agency that provides clinical nutrition
5 services to individuals with HIV/AIDS and other
6 chronic diseases.
7 (B) One representative of a teaching medical
8 hospital that collaborates with community social
9 service providers.
10 (C) One representative of a social service agency
11 that provides outreach, counseling, and housing for
12 chronically ill individuals.
13 (D) One person who is a licensed physician with
14 expertise in treating individuals with chronic
15 illnesses, including heart disease, hypertension, and
16 HIV/AIDS, among others.
17 (E) One representative of a not-for-profit
18 community based agency that provides direct care,
19 supportive services, and education related to chronic
20 illnesses, including heart disease, hypertension, and
21 HIV/AIDS, among others.
22 Each Commission member shall serve for a term of 3 years
23 and until his or her successor is appointed. Vacancies shall be
24 filled in the same manner as original appointments.
25 (c) The Commission shall meet to organize and select a
26 chairperson upon appointment of a majority of the members. The

1 chairperson shall be elected by a majority vote of the members
2 appointed to the Commission. The Commission shall meet at least
3 4 times a year at the call of the chairperson. Members of the
4 Commission shall serve without compensation, but may be
5 reimbursed for reasonable expenses incurred as a result of
6 their duties as members of the Commission from funds
7 appropriated to the Department for that purpose.
8 (d) The Commission shall submit an annual report to the
9 Department on or before July 1, 2011 and on or before July 1 of
10 each year thereafter with its recommendations.
11 (e) The Department shall provide administrative and staff
12 support to the Commission.
13 Section 99. Effective date. This Act takes effect upon
14 becoming law.
