Bill Title: Creates the Jobs Creation Task Force Act. Defines terms. Creates the Jobs Creation Task Force. Provides that the Task Force shall consist of 8 members. Provides term lengths for specific members and voting requirements. Provides that the Task Force shall review each regulated occupation every 5 years. Provides that the Task Force shall review any proposal to license a new occupation upon the request of a member of the General Assembly or a legislative staff member or legislative services agency on behalf of a member of the General Assembly. Provides that the Task Force shall prepare an annual report to submit to the General Assembly and Department of Financial and Professional Regulation regarding each regulated occupation the Task Force reviews. Provides specific information to be included in the annual report. Provides that the Task Force shall seek and consider public input when considering any reports recommending the elimination of a license or a change to a regulated occupation. Provides that the Governor's Office of Management and Budget shall provide staff and administrative support to the Task Force and that all expenditures of the Task Force shall be paid by appropriations from the Office. Provides that each member of the Task Force is entitled to reimbursement for traveling and other expenses incurred in connection with the member's duties.

1 | AN ACT concerning regulation.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 1. Short title. This Act may be cited as the Jobs | |||||||||||||||||||
5 | Creation Task Force Act.
| |||||||||||||||||||
6 | Section 5. Definitions. In this Act: | |||||||||||||||||||
7 | "Board" means a board created by the Department of | |||||||||||||||||||
8 | Financial and Professional Regulation to oversee a specific | |||||||||||||||||||
9 | regulated occupation. | |||||||||||||||||||
10 | "Department" means the Department of Financial and | |||||||||||||||||||
11 | Professional Regulation. | |||||||||||||||||||
12 | "Office" means the Governor's Office of Management and | |||||||||||||||||||
13 | Budget. | |||||||||||||||||||
14 | "Regulated occupation" means any occupation regulated by | |||||||||||||||||||
15 | the Department of Financial and Professional Regulation. | |||||||||||||||||||
16 | "Secretary" means the Secretary of Financial and | |||||||||||||||||||
17 | Professional Regulation. | |||||||||||||||||||
18 | "Task Force" means the Jobs Creation Task Force.

19 | Section 10. Members; terms; voting. | |||||||||||||||||||
20 | (a) The Jobs Creation Task Force is created, which shall | |||||||||||||||||||
21 | consist of the following 8 members: | |||||||||||||||||||
22 | (1) the Secretary or the Secretary's designee, as |

1 | Chairperson of the Task Force; | ||||||
2 | (2) the Director of the Office or the Director's | ||||||
3 | designee; | ||||||
4 | (3) the Attorney General or the Attorney General's | ||||||
5 | designee, as a non-voting member; | ||||||
6 | (4) one individual to represent an association that has | ||||||
7 | small businesses, small business owners, or licensed | ||||||
8 | professionals as a majority of its members, appointed by | ||||||
9 | the Governor to serve at the pleasure of the Governor; | ||||||
10 | (5) 2 individuals licensed in a regulated occupation, | ||||||
11 | appointed by the Governor; and | ||||||
12 | (6) 2 individuals not licensed in a regulated | ||||||
13 | occupation, appointed by the Governor. | ||||||
14 | (b) Task Force members appointed under paragraphs (5) and | ||||||
15 | (6) of subsection (a) shall serve for a term of 3 years. | ||||||
16 | (c) For action to be taken by the Task Force on any matter, | ||||||
17 | there shall be affirmative votes from the majority of the | ||||||
18 | voting members.

19 | Section 15. Review; annual report; public input. | ||||||
20 | (a) The Task Force shall review each regulated occupation | ||||||
21 | and the review shall include the following: | ||||||
22 | (1) the functions, powers, and duties of a regulated | ||||||
23 | occupation and board, including any functions, powers, or | ||||||
24 | duties that are inconsistent with current or projected | ||||||
25 | practice of a regulated occupation; |

1 | (2) an assessment of the management efficiency of a | ||||||
2 | board; | ||||||
3 | (3) an assessment of a regulated occupation and board's | ||||||
4 | ability to meet the objectives of licensing a regulated | ||||||
5 | occupation; | ||||||
6 | (4) an assessment of the necessity, burden, and | ||||||
7 | alternatives to the licenses issued by a board; | ||||||
8 | (5) an assessment of the fees that a board charges for | ||||||
9 | licenses; and | ||||||
10 | (6) any other criteria the Task Force deems necessary. | ||||||
11 | (b) A board shall cooperate with the Task Force in the Task | ||||||
12 | Force's review of a regulated occupation and board. The Task | ||||||
13 | Force shall allow testimony from a board regarding each | ||||||
14 | regulated occupation the Task Force reviews. | ||||||
15 | (c) The Task Force shall establish a schedule to review | ||||||
16 | each regulated occupation. Each regulated occupation shall be | ||||||
17 | reviewed at least every 5 years. | ||||||
18 | (d) The Task Force shall review any proposal to license a | ||||||
19 | new occupation upon the request of a member of the General | ||||||
20 | Assembly or a legislative staff member or legislative services | ||||||
21 | agency on behalf of a member of the General Assembly. | ||||||
22 | (e) The Task Force shall prepare a report regarding each | ||||||
23 | regulated occupation the Task Force reviews. The Task Force | ||||||
24 | shall submit such a report annually to the General Assembly and | ||||||
25 | the Department. The report shall contain the following | ||||||
26 | information: |

1 | (1) the number of individuals licensed in a regulated | ||||||
2 | occupation; | ||||||
3 | (2) a summary of a board's functions and actions; | ||||||
4 | (3) the budget and other fiscal factors of regulating a | ||||||
5 | regulated occupation, including the actual cost of | ||||||
6 | administering license applications, renewals, and issuing | ||||||
7 | licenses; | ||||||
8 | (4) an assessment of the effect of a regulated | ||||||
9 | occupation on the State's economy, including consumers and | ||||||
10 | businesses; | ||||||
11 | (5) any recommendations for legislation, including | ||||||
12 | whether: | ||||||
13 | (A) the regulation of a regulated occupation | ||||||
14 | should be modified; | ||||||
15 | (B) a board should be combined with another board; | ||||||
16 | (C) a board or the regulation of a regulated | ||||||
17 | occupation should be terminated; | ||||||
18 | (D) a license should be eliminated; or | ||||||
19 | (E) multiple licenses should be consolidated into | ||||||
20 | a single license. | ||||||
21 | (6) any recommendations for administrative changes; | ||||||
22 | and | ||||||
23 | (7) any information that supports the Task Force's | ||||||
24 | recommendations. | ||||||
25 | (f) When considering any reports recommending the | ||||||
26 | elimination of a license or a change to a regulated occupation, |

1 | the Task Force shall seek and consider public input.
| ||||||
2 | Section 20. Staff; member reimbursement; expenditures. The | ||||||
3 | Office shall provide staff and administrative support to the | ||||||
4 | Task Force. The Task Force may hire, with approval of the | ||||||
5 | Chairperson, an individual to assist the Task Force. Each | ||||||
6 | member of the Task Force is entitled to reimbursement for | ||||||
7 | traveling and other expenses actually incurred in connection | ||||||
8 | with the member's duties. The expenditures of the Task Force | ||||||
9 | shall be paid from appropriations to the Office.
