Bill Title: Amends the Counties Code and the Illinois Municipal Code. Provides that the board of health of a county, multi-county health department, or municipality, as applicable, shall issue a permit for the operation of a seasonal food service establishment. Sets forth procedures concerning the renewal of a license. Provides that "seasonal food service establishment" means a food establishment, other than a mobile food establishment, that is operated for no more than 5 months in a licensing period. Effective immediately.

AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Counties Code is amended by adding Section
5-25028 as follows:

Sec. 5-25028. Seasonal food service permits. The board of
health of a county or multi-county health department shall
issue a permit for the operation of a seasonal food service
establishment. In the case of a seasonal food service
establishment, a person or entity seeking license renewal shall
submit an application for renewal to the board of health of a
county or multi-county health department, as applicable,
before commencing operation in a new licensing period.
"Seasonal food service establishment" means a food
establishment, other than a mobile food establishment, that is
operated for no more than 5 months in a licensing period.
Section 10. The Illinois Municipal Code is amended by
adding Section 11-20-17 as follows:

Sec. 11-20-17. Seasonal food service permits. A

municipality shall issue a permit for the operation of a
seasonal food service establishment. In the case of a seasonal
food service establishment, a person or entity seeking license
renewal shall submit an application for renewal to the
municipality before commencing operation in a new licensing
period. "Seasonal food service establishment" means a food
establishment, other than a mobile food establishment, that is
operated for no more than 5 months in a licensing period.
Section 99. Effective date. This Act takes effect upon
becoming law.
