Bill Title: Amends the Downstate Teacher Article of the Illinois Pension Code. Reduces the composition of the Board to 11 members (instead of 13 members) by removing 2 of the members of the Board appointed by the Governor. Provides that the 2 members whose office is being abolished pursuant to the amendatory Act shall be from the members whose terms of office expire on July 14, 2018. Effective immediately.

| 1 | AN ACT concerning public employee benefits.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 5. The Illinois Pension Code is amended by changing | ||||||||||||||||||||||||||
| 5 | Sections 16-163 and 16-164 as follows:
| ||||||||||||||||||||||||||
| 6 | (40 ILCS 5/16-163) (from Ch. 108 1/2, par. 16-163) | ||||||||||||||||||||||||||
| 7 | Sec. 16-163. Board created. A board of 11 13 members | ||||||||||||||||||||||||||
| 8 | constitutes the
board of trustees authorized to carry out the | ||||||||||||||||||||||||||
| 9 | provisions of this Article and is
responsible for the general | ||||||||||||||||||||||||||
| 10 | administration of the System. The board shall
be known as the | ||||||||||||||||||||||||||
| 11 | Board of Trustees of the Teachers' Retirement System
of the | ||||||||||||||||||||||||||
| 12 | State of Illinois. The board shall be composed of the
| ||||||||||||||||||||||||||
| 13 | Superintendent of Education, ex officio, who shall be the | ||||||||||||||||||||||||||
| 14 | president of the
board; 4 6 persons, not members of the System, | ||||||||||||||||||||||||||
| 15 | to be appointed by the Governor,
who shall hold no elected | ||||||||||||||||||||||||||
| 16 | State office; 4 persons who, at the time of their
election, are
| ||||||||||||||||||||||||||
| 17 | teachers as defined in Section 16-106, elected by the
| ||||||||||||||||||||||||||
| 18 | contributing members; and 2 annuitant members elected by the | ||||||||||||||||||||||||||
| 19 | annuitants of the
System, as provided in Section 16-165.

| 22 | Sec. 16-164. Board - appointed members - vacancies. Terms | ||||||||||||||||||||||||||

| 1 | of office for
the appointed members shall begin on July 15 of | ||||||
| 2 | an even-numbered year, except that the terms of office for | ||||||
| 3 | members appointed pursuant to this amendatory Act of the 96th | ||||||
| 4 | General Assembly shall begin upon being confirmed by the | ||||||
| 5 | Senate.
The Governor shall appoint 2 3 members as trustees with | ||||||
| 6 | the advice and consent of the Senate in each even-numbered year
| ||||||
| 7 | who shall hold office for a term of 4 years, except that, of | ||||||
| 8 | the members appointed pursuant to this amendatory Act of the | ||||||
| 9 | 96th General Assembly, 3 members shall be appointed for a term | ||||||
| 10 | ending July 14, 2012 and 3 members shall be appointed for a | ||||||
| 11 | term ending July 14, 2014. Each such appointee shall reside in | ||||||
| 12 | and be
a taxpayer in the territory covered by this system, | ||||||
| 13 | shall be interested
in public school welfare, and experienced | ||||||
| 14 | and competent in financial and
business management. A vacancy | ||||||
| 15 | in the term of an appointed
trustee shall be filled for the | ||||||
| 16 | unexpired term by appointment of the
Governor.
| ||||||
| 17 | The 2 members whose office is abolished pursuant to this | ||||||
| 18 | amendatory Act of the 100th General Assembly shall be from the | ||||||
| 19 | members whose terms of office expire on July 14, 2018. | ||||||
| 20 | Notwithstanding any provision of this Section to the | ||||||
| 21 | contrary, the term of office of each member of the Board | ||||||
| 22 | appointed by the Governor who is sitting on the Board on the | ||||||
| 23 | effective date of this amendatory Act of the 96th General | ||||||
| 24 | Assembly is terminated on that effective date. A trustee | ||||||
| 25 | sitting on the Board on the effective date of this amendatory | ||||||
| 26 | Act of the 96th General Assembly may not hold over in office | ||||||

| 1 | for more than 60 days after the effective date of this | ||||||
| 2 | amendatory Act of the 96th General Assembly. Nothing in this | ||||||
| 3 | Section shall prevent the Governor from making a temporary | ||||||
| 4 | appointment or nominating a trustee holding office on the day | ||||||
| 5 | before the effective date of this amendatory Act of the 96th | ||||||
| 6 | General Assembly. | ||||||

| 8 | Section 99. Effective date. This Act takes effect upon | ||||||
| 9 | becoming law.
